The trump team must then file a petition for writ of certiorari to ask the USSC to grant review of the Third Circuits ruling. See the thing is, cases do not automatically get reviewed by the USSC. Otherwise it would be flooded with appeals from across every circuit in the country. It must grant review. Also,it is both stupid and incorrect to say “this is where they wanted to go”. The relief sought at the Third circuit was a ruling that the district court erred in not allowing team trump to file yet another amended complaint and a remand to the district court with instructions to allow the amendment. The relief sought, if the USSC grants review, will be that very same ruling and very same remand. Losing at the third circuit is not “where they wanted to go”. Lastly, you seem to miss the key point or just refuse to acknowledge it. A remand is not some form of victory. Rather — and read this carefully - it’s a do over. A chance to not lose the case again at the earliest stage possible .... namely, dismissal for failing to file a comprehensible legal claim with sufficient allegations to articulate a claim. It is both stupid and incorrect to suggest that team trump wanted to lose at the Third Circuit, so that they could go to the USSC. You need to stop reading dumb headlines and understand how actual court proceedings work.
