The mom definitely was an idiot and so was the Cops. First dumb decision she made was driving off while the cop was writing a ticket. First dumb decision the cop made was over reacting and responding with such anger after he pulled her over the second time. What was the point? She obviously was idiotic for driving off, but she pulled over... He got her on the traffic ticket and on driving off or even evading an officer, so whats the point with acting like a drill seargent. He could've calmly waited for backup IF he really wanted to arrest her (which imo is excessive) as he would need to anyways (to deal with the kids) OR he simply could've issued her multiple tickets and be on his way. Of course he took the third option, which was screaming and yelling at her for evading arrest and by himself attempting to arrest a women with 5 kids to deal with... whats the point of escalating the situation by himself, besides him exerting an over sense of authority/power. Instead of causing a huge commotion, calmly talking to her while letting her stay in her car, while backup arrives which would've resulted in a much less chaotic and dangerous situation. Everything that happens after his a cluster**** of stupidity. From the mother resisting arrest, to the cop hitting the car with his baton, to the mom driving recklessly in an attempt to escape and the cop shooting at a moving fan with 5 kids inside. The last two are easily the most egregious. She was risking her and her kids life to evade a traffic violation and resisting arrest charge (she drove off before shots were fired). The idiot cop was attempting to shoot a moving vehicle w/innocent bystanders to capture a suspect accused of speeding and attempting to escape from the ticketing. Really?
That's a HUGE thing. A car with 5 kids and the mother in it, gets shot at over a speeding ticket. Insane. Not saying the mother did the right thing, but what the cops did is inexcusable and completely unnecessary.
No, the car didn't get shot at because it was speeding. The tires of the car got shot at because the car was speeding away trying to outrun the police. The only issue I have with the cops is them trying to break the window. I understand the instinct of wanting to shoot out the tires while a car is speeding away to evade you. I don't think they needed to break the windows when the 14 year old didn't want to open the door though.
There's nothing wrong with the cop breaking the window. The 14 year old had previously attacked the cop. Since he was refusing to get out of the van, the cop was going to forcibly bring him out. It was totally justified.
It doesn't matter whether he was aiming for the tires or the cab it was still reckless and endangered both the passengers and his fellow officers. This isn't a TV show where people can just easily hit the tires of a moving car. They are a small target compared to the rest of the van and the officer isn't target shooting but engaged in a rapidly changing and stressful situation where he doesn't have time to take good aim. Further anyone who has had a blowout or seen a blowout on the highway know that a car doesn't all of sudden stop when a tire blows but continues for awhile with little control that would put the passengers and other officers nearby in even more danger. What I don't get about this situation is that there is a squad to the left of the van but not blocking it. Since the initial officer already knew this woman was a flight risk enough to call in back up why didn't the back up just block in the van to keep her from jumping back in and driving off? For that matter instead of trying to shoot out the tires why not just call for more back up co cut off the escape through blocking the van or using stop sticks? As a friend of mine who is an ex cop told me "you can't outrun radio."
