definitely seen first-hand someone take an apology just because someone felt bad for someone else (after a car accident) and use it against them in court. Wait until it's 100% settled.
When someone rear ends you and pushes you into another vehicle, liability is going to rest with that person 99.9% of the time. The only way that person would be absolved of being negligent would be if there was a witness, or proof showing you pulled in front and cut them off. IOW, you telling a person that it is "ok" and not to feel bad by no means absolves them from negligence in the accident. I would be careful though. By you having direct contact with the policy holder outside of the claims process, if an SIU situation were to rear its ugly head, it would look suspicious.
I'm guessing that, for some reason or another, the guy in front of you slowed down, which required that you slow down, and in turn the Lexus to do the same. The Lexus driver wasn't paying attention (was also riding too close) and rear ended you, which in turn caused you to rear end the guy in front of you. Of course, as Bobrek said, I wasn't there and don't know the circumstances, so I can't really say that it was as simple as leaving more space between you and the guy in front of you, but I've seen this same accident scenario play out over and over again in low speed accidents on the highways during rush-hour. The solution, leave more space between you and the car in front of you. If you don't have to suddenly brake, the guy behind you is less likely to look away for the split second that it takes for it to be too late.
Well, the insurance company called and got my statement of what happened. They said my medical bills will be paid for and they'll pay for pain and suffering along with lost wages. They said they would figure out how much my vehicle was worth and pay for it. They are providing a rental car until that is done. Is all this pretty standard?
^ I haven't been through a situation like this before, but that sounds like standard procedure. was it your insurance that called or theirs? Who is their insurance with?
Your referring to the other party's insurance company right? That hasn't been standard in my cases, where the other party's company has always tried to screw me over. It took months to get a claim settled where I was t-boned by someone running a red light, them getting cited by the police and having a good samaritan witness. Most likely my issue is not claiming injuries even though I miraculous came out unscathed. I believe insurance companies are quicker to settle claims that involve medical in case your condition gets worse over time.
I was side swiped a couple of years ago by a high school kid trying to make a right turn 3 lanes away. I took all of her information down and her mothers. A week went by where they wouldn't return my calls and they hadn't contacted their insurance. The very next week I got a lawyer and he took care of it and got me some money too. I would advise to get one and save yourself the stress. I didn't have to pay any doctor fees upfront everything was taken care of.
Their insurance and they are with Farm Bureau. They called back and offered $6400 for my vehicle. I thought that was pretty good considering I only paid $6500 for it and that was 3 years ago.
