    No place that I have heard of in the EU can you have your money seized and then have to prove a negative in a process that takes over a year to get it back. Please provide any supporting information at all.

    Resorting to insults? That goes agains everything you vilify the "left-wing" for.

    Because (as ilustrated by Ottomaton) they do not follow "due process of law." I don't have a problem with seizing and keeping drug dealers' profits, but it needs to be at a trial where the government proves that the money was related to drug dealing.

    That is not your choice to make. If he feels safer with the money in the cab of his truck, that is his choice. The government should have to prove that the money was gained illegally before they can hold it.

    Except that now he can't pay his bills. He also has to incur legal fees that he can't pay because the government is holding his money.

    Which proves my point that the drug war has warped our collective thinking to the point that these kinds of actions are justifiable to some people.

    All it would take is someone planting enough cocaine in your house that it would qualify as drug dealing for you to lose your house, cars, bank accounts, and everyting else you have. Since drugs were found at the scene, you probably wouldn't even have a remote chance of getting it back, even if you could show every single dollar in cash flow for the past few years. All it takes is one cash deposit and they would consider the funds "mingled" and would take it all.

    I am so sorry you are so clueless and misled on this issue, but it again proves the point.

    It's not a no-no, you just have to declare it. Not very astute of you. And neither you nor I know whether he declared it. But logic dictates that since he declared it to the cop, he would have declared it at customs.

    Really? Prove that the drug war has been effective. I can show you many statistics that say that the drug business is doing well despite the "war on drugs."

    Wait - this money was his savings right? Now he needs to spend his savings?

    Yeah right. The more I read, the more I realize this guy was up to something illegal and I'm glad his dirty money was taken. At first I thought it was unfair, now I realize it's him, not the law.

    Let's review:

    1. He has 23K in cash. We don't know if it was all 20's of the same demonination or if it was a bunch of cruppled up 100's. That certainly would make a difference.
    2. He was a truck driver living in El Paso but he went through customs. Why? Did he cross the border? The details of this were not revealed.
    3. He claims the money was for savings...but now he needs to spend his savings for repairs? Nice timing!
    4. He says he had income stubs proving the cash is legit. Ok, this is the one that got me. Not only does he carry his savings with him in his truck - but he also carries proof on how he got the money!?!?!?!

    Think about that. That means he knows someone might question him on the legitmacy of the money - that means he knows it's suspicious to carry around that much cash, which means he knows it's associated with illegal activity. He knows people put their money in the bank, and he knows he could lose his money if he is stopped. And yet he does it anyway.

    He must know what's up. He lives in El Paso. He works in transportation. He must know about all that goes on in his locality. This guy isn't some victim, he's up to no good. The authoritizes realized this and seized his money.

    Good for them.

    No. I'm saying charging property as a criminal party in order to get around constitutional protections against illegal searches&seizure is...well, unconstitutional.

    Just because the statute allows it doesn't mean it negates basic tenets of justice.

    why don't you go watch Traffic another 20 times? This isn't about how effective the drug war is or isn't. But you have to try to stop crime.

    There are murders in a city, does that mean you just let them happen? Oh well, we can't stop murders, so let's just stop going after murderers?

    What your view is on the drug war is one thing, but these guys are doing their jobs...and that's seizing cash near border areas under suspicious circumstances.

    And to compare drug trafficking to speeding is a joke. You have no idea the impact of drugs can have on communities and on people's lives if you try to defend drug trafficking. Really just crazy.

    Didn't say anything about stopping murderers. Did say something about breaking into peoples homes and stealing their guns because they might commit murder with them.


    That's a subjective judgement.

    Funny, because i'm using the speeding argument as a foil to your "omg having lots of cash near a border means automatically you're related to drugs!" argument.

    And yes, all debates have a subjective element, but when you base your entire argument on the subjective, don't expect me to give it any credibility.
