    I'm pretty sure he can't confiscate the tape. That would be taking the phone. People video tape police incidents all the time.


    Not the same, at all. 4 locos has alcohol in it, this does not. And your friend is Mexican, this guy is black. :p

    No i have used the words probable cause a few times already. Like i said before, i dunno how long they were there or what they were doing before the cop went up to them. Most open container laws allows a cop to check the contents of an open ontainer in their possession if the person is acting up.

    My mistake i thought you lived in nyc.

    Well based on the video, looks he just got out of the car (video opens, shuts car door, car still running) and it doesn't take long until the cop shows up. Didn't see him acting up in that time. Looked like a power trip to me

    Does anyone know, if a cop does have the right to sniff your drink if he suspects you of drinking in public? Pretty invasive, but if they can't, then anyone could drink anywhere they wanted so long as it's in a nonalcoholic labeled container. I'm certain they can while you're driving, but sniffs only (NO SIPS)!


    In texas it does.
