You are contradicting yourself. Should his friends have gone into "angry black man rage?" 3. The guy did not do anything wrong; this is completely on the cop. Who gives a ****? It was still wrong. I would not debate in this thread. I'm sure there are a few posters that want to say he is at fault, but don't know how to argue it. So far we have he is at fault for: 1) Angry black man rage 2) Being fake 3) Having alcohol in an Arizona Tea can (who does that? and why?)\ 4) Having fake friends 5) Trolling 6) Not complying to a random stranger asking to see what flavor his drink is 7) Living in the ghetto The cop should be fired.
Going by the assumption that they didnt believe he was a cop? Uh the same thing id expect my friends to do should a stranger try to take me down.
Its pretty simple. A cop has the right to inspect your drink in most places to make sure its not alcohol. Flying into a rage and reading him the nutritional label of your container when he makes his request is generally not a good idea. Had the cop displayed his badge first, the black guy could have been arrested for obstruction after the third or fourth time the cop asked to inspect the can. As i said in my other post, if you dont think hes a cop, then do something when when your friends getting taken down. If you believe hes a cop then tell your friend to stfu and just hand over the can for a 5 second test that would save everyone a lot of trouble. Has anyone considered at all that there might have really been alcohol in the arizona can?
Yes he should have displayed his badge and identified himself as a cop before any interaction with the drinker. Protocol is there for a reason.
Probable cause is the magic word. In this case maybe the drinker had been acting like a fool before he cameras were rolling and the cop might have been looking at him for a while before the cameras rolled. Or it might have been a simple case of drinking while black. Either way establishing probable cause is probably one of the easiest things for cops to do
1. The citizen has the right to refuse handing his can of ice tea over...but if for some reason he gives him the can, the cop can do whatever with it. This sadly would be considered an illegal search and seizure of property... 2. he wasnt flying into a rage...i dont think you have many black friends at all..so you really have no clue what you are saying. if anything, I thought the guy was antagonizing the cop a bit, but he was well within his rights to have said what he said...The guy was surprisingly calm.. 3. Just because a cop flashes his badge, doesnt mean you have to bend over backwards for him. In order for a cop to engage a conversation with you, he has to identify himself and state the reason for stopping a citizen. He was just in front of a liquor store. While i have no idea if the trespassing violation has merit, the civilian properly stated that he was going to get something from the store. Therefore, he wasnt trespassing. and who cares if he had alcohol in that can...it cant be proven, and no police officer has the right to take your possession from you. You mention a fancy word, but then you go on speculating the incident. You werent there, and you have no clue about what took place outside the video. The video is clear and concise that the civilian did nothing wrong, and the police officer was intimidating the person. There is zero probable cause to suspect that a grown adult male would, replace the contents of a ice tea can with alcoholic content. The cop was under the assumption that he was carrying a 40 oz... and wanted to illegally detain him. This is a classic example of abuse of power, and the police officer will get fired, and lose his job over a momentary and fleeting sense of power...PS. he most likely will have a civil case against him as well...
no they dont. the problem is that he never id'ed himself as a cop. furthermore, i would hardly qualify "black" guys reaction as "Flying into a rage". he never raised his voice or did anything aggressive. under the circumstances, i think it was impressive how well he kept his cool...even as that stupid cop was cuffing him. and it would have been unjustified. the police only charged him with trespassing and resisting. you dont think they inspected the can after he was cuffed? i do think it is odd that they just happened to be filming before the cop arrived...all they were doing was hanging out in a parking lot...why were they filming?
If you are drinking out of a can, no matter what type of can it is, and acting foolishly in public, that is probable cause for a cop to inspect your drinking container in most municipalities. Its not that hard a concept. The charges will probably stick except for the trespassing. The cop should be reprimanded for not following protocol and properly identifying himself before interacting with the drinker. You really should look up obstruction and Resisting arrest. Even if its a bs thing and you are exonerated for whatever it was they arrested you for, the resisting arrest can still stick. In the same way a guy in jail whose conviction gets overturned can still be stuck in jail had he tried to escape.
How was he acting foolish in public? If a random guy came up to me like that on the street I would be freaking out. Just because he has a p*rn stache doesn't mean he's a cop.
lol...more fancy words...obstruction? What is the civilian doing that is obstructive. The police officer isnt conducting an investigation. And even if he is...he lacks proper documentation and appropriate warrants to conduct searches at random, etc. None of that was even presented when civilian was questioned. Secondly, I can walk around and act like a total fool, as long as i am not harming myself, those around me, or causing destruction to property. None of those things were seen in this video. None of the charges will stick. Period. If i was the guy, I would sue for assault and battery, mental distress, illegal detention.(there maybe more things, but im not a lawyer...i just have common sense) I think im arguing against a wall...so here ends my reasoning with someone that probably just doesn't get what rights you have...
Lol you live in a state that has some of the tougher open container laws in the county. You really think a cop needs a warrant to search open containers for alcohol in states that have those laws?
