Dance teacher sentenced to year in prison for having sex with teen student

A 34-year-old North Ridgeville tap dancing teacher was sentenced Tuesday to one year in prison after being convicted in a jury trial of one count of unlawful sexual conduct with a minor.

The victim, a boy who was one of the woman’s students, was 15 at the time of the offense, according to evidence revealed in open court.

Kimberly Elaine Sauto and the boy had a sexual relationship that came to light, prosecutors said, when Sauto’s husband reported it to Sagamore Hills police after finding condoms in his wife’s dance bag, along with text messages between her and the victim on her phone.

Summit County Assistant Prosecutor Aaron Howell asked Common Pleas Judge Judy Hunter for a four-year sentence, noting that Sauto gave alcohol to the boy in the time leading up to the offense.

It didn’t happen just once, he told the judge.

Holding a copy of the pre-sentence findings as he addressed the court, Howell said the report showed the relationship between Sauto and the boy changed after she gave him alcohol.

“He drank to the point of passing out,” Howell said.

Sauto also took advantage of her position of power, authority and trust as a teacher, he said.

“We heard that from family members who testified. They trusted her as if she was a family member. They trusted her to take their son, to go on trips and to stay with him, and all that time they were doing that, she was betraying that trust,” Howell said.

It was a disturbing case “to say the least,” he added, pointing out that Sauto rejected prosecution attempts to resolve the case without going to trial.

And he wasn’t finished arguing for a harsh sentence.

After Sauto was convicted in her jury trial and sent to jail, Howell said the pre-sentence report revealed that she “continued to have sexual fantasies about the victim” and admitted pleasuring herself during the fantasies as late as Feb. 10 when the report was made.

Under Ohio sentencing law, the maximum penalty for Sauto’s third-degree felony conviction is five years in prison.

The victim and his family were not present in court, but in a letter read by Victim Services worker Maureen Vos, the boy’s mother asked Hunter to impose the harshest sentence provided by law.

Hunter, however, gave Sauto one year, saying she was required to take all sentencing guidelines into account.

The pre-sentence report, Hunter stressed, showed Sauto was a first-time felony offender who had never been previously involved in any kind of trouble with the law.

She said she felt the prosecution’s recommendation was “too harsh.”

Hunter also classified Sauto as a sexually oriented offender, ordering her to register her address with sheriff’s officials every six months for 25 years after her release from prison.

Under additional terms of the sentence, Sauto is assured of serving less than one year’s time, because she will be given credit for 52 days in the county jail since her conviction early this year.

A slight woman, wearing gray-striped jail clothes and shackles with her hair pulled back into a ponytail, Sauto wept as she addressed the court.

“As you sentence me,” she told Hunter in a subdued voice, “I’m asking for mercy, not just for myself but for my children and my family.”

She said she has two children, ages 9 and 5.

At Hunter’s urging, Sauto concluded her statement by turning to the public gallery and issuing an apology.

“I know that his has been painful and humiliating to many people and to many families,” Sauto said, “and to them I do apologize.”

I don't understand why she would admit to fantasizing and pleasuring herself about him and after going through a trial to prove her "innocence."

I don't usually say this, because that whole "what a lucky kid" thing comes off as a bit misguided IMO, but this time... I mean seriously, that 15 year old must be pissed the hell off at that husband. He would get to go on field trips with his moderately attractive dance teacher and hang out with her outside supervision to have sex, and she would give him alcohol? Tell me what 15 year old boy doesn't want exactly that.

For the teacher however, the fact that she was carrying out an affair with a 15 year old boy while having two children ages 9 and 5 certainly sheds a little bit of insight on what kind of a person she was. That's just incredibly stupid and irresponsible.
