I do not have you on ignore nor do I feel like your posts are unworthy of a response.

I completely understand the "it's not that big of a deal" position. In another circumstances, I'd ignore it. If the guy had called me, I'd have hung up in the first 30 seconds, tbh. Even if the guy had annoyed me, I'd ignore it.

My wife's a different issue altogether. Even if the grounds were trivial, she became upset. That is what pisses me off.

I think that I'm going to just write one letter and be done. After my initial fury, I'm just not sure what I'm going to accomplish here. Still, I believe that his (a) blatant flouting of the law and (b) rudeness deserve some remark, at least.

it'd be a tragedy if anyone had me on ignore.

i mean how can you have someone on ignore that's always right?

I think that is a good plan. As Max said, no need to be an agry letter, just address the issues in a straightforward way.

Incidentally, congrats on finishing law school, marriage, and future child. I must have missed some of those life updates along the way. Since we "go back" I thought I would pass along my well wishes despite any tardiness.

Everyone is a damn lawyer these days. If it weren't for all of you guys I might have gone into law school.

Wow, haven it seems like you just started law school. Congrats. I had a similar situation with a debt collector. I asked to be taken off the list and the woman just started talking over me saying she'd call back another time and then hung up on me. Luckily I have caller id so i just called the number, asked to talk to a supervisor - gave him her name and explained my distain at being talked over and hung up on, and repeated my request to be taken off the list. He agreed right away and I haven't heard from them since. You're not going to get anyone fired I don't think because while most of us wouldn't cave to an overly aggressive caller, some do - so the companies encourage it. I don't think you'd get anything out of suing them since you didn't suffer any damage.

    haven,

Thanks for the response and sorry for my surlyness to you earlier - it was uncalled for. It is easy for me to sit back and tell you to drop it since it didn't happen to me or to someone I loved, but now I understand your position. This bill collector upset someone you loved in your wife and I don't blame you one bit for wanting to write a letter to him. To me, nothing is worse than seeing someone hurt a person you love or care for.

Probably, but I have felt that for the longest time that haven had me on ignore so I decided to post what I did. It worked as I got a response, didn't it? :p ;)

    EXCELLENT IDEA MANNY.

Freaking awesome. Especially the sleeping on the letter first. Love that. Nothing says "This is a nasty letter" like making it reak of body funk.

    That rocks.

Incidentally, it's nice to hear all the comments from Rimbaud, Zac_D, madmax, Hayesstreet, Rocketman95, and others.

rimbaud: Thanks on the belated congratulations :).

Hayesstreet: Time does fly by, doesn't it? When I started posting on this site, I was a sophomore in college. Now I've got my first "real" job.

As a bankruptcy attorney, I have experience with clients who have fallen prey to overly aggressive, intimidating collectors.

Under state and federal laws, these actions appear to be violative of statutory provisions. Even if there is no real damage, there are statutory penalties.

My recommendation is to report them to the Attorney General's office. They investigate these types of things in the name of the state of Texas.

Also, talk to the judge you are clerking for. He may have some suggestions.

Congrats on Bar passage. Welcome to our little social club. What city are you in and what court are you clerking for?

It's a good job. I practice daily in the Bankruptcy Court, Southern District of Texas.

If you're ever down this way, we should have lunch.

I'm partly jesting. I grew up in lufkin, which is smaller than Beaumont. But I've also lived in Houston (very briefly), Boston (college), Austin (law school), and will return to Boston when my clerkship is finished in 2 years (my wife has a job with a big firm there). So compared to those places - its a bit restrictive.

There's nothing wrong with small town Texas. I just prefer the big cities.
