how would one prove something is illegal? Every commentator I have seen outside the Obama administration has claimed it was illegal.

 

The guy wasn't captured last week. He's been in captivity for 5 years....How come we are just now hearing about his abandonment? Why weren't republicans and all the guys coming out now calling him a traitor for the past 5 years? Why isn't anyone (on the right) waiting to pass judgement on this?

Dying is what soldiers do sometimes. What it comes down to is that sending in an extraction team would have been an appropriate method to retrieve him. Negotiating with terrorists and releasing high level Taliban leaders from prison, especially without permission or consultation of congress wasn't an appropriate method of retrieving him. Simple as that.

This isn't a Democrat vs Republican issue, this was the president acting unilaterally against the wishes of both parties and in a foolish and potentially illegal manner (according to Senator Feinstein).

There have been allegations from both sides of the aisle that the actions were illegal because in a bill Obama signed, it stated that he had to give Congress 30 days notice before any prisoner swap could happen. He chose to ignore it stating that it shouldn't apply to him. High ranking members of his own party disagree.

 

Not to mention calling Hitler's Nazi Party (the National Socialist German Workers' Party) "Leftist." Bizarre.

 

Then why are the guys from his platoon making a fuss on TV about other soldiers that died trying to rescue him?

Like I said before...how do we know if the president doesn't have some sort of plan regarding the detainees?

 

Sources: Bergdahl may have walked off base more than once

An internal military investigation found that Army Sgt. Bowe Bergdahl intentionally sneaked away from his forward operating base in Afghanistan just before he disappeared in 2009 — and that may not have been the first time he left the post without permission, according to officials familiar with the probe.

“We have no indication that he intended to leave permanently,” one government official familiar with the investigation told Military Times. Several soldiers in Bergdahl’s unit told investigators that Bergdahl talked about his desire to leave the base unaccompanied and that he may have done so and returned unharmed at least once before the night he disappeared for good, the official said.

The internal investigation, known as an AR15-6, was completed in 2010 and remains classified, but several officials familiar with it have disclosed its results under condition of anonymity.

The investigation determined that there was little doubt Bergdahl walked away from his unit before he was captured.

What happens if next week or tonight all 5 detainees are killed in a drone attack because they were tracked meeting with other Taliban leaders?

I understood you, but your statement contradicts mark's claim that Republicans have been criticizing Obama for years abotu not getting Bergdahl back (you claim they haven't said a word). To answer your question though, the reason you are hearing about it now is because of the cost (5 Taliban leaders) and the manner which it was done (illegally and without Congressional approval)
