That might be true but it's perfectly reasonable to criticize not only this swap but Obama disregarding the law. The power of the executive continues to grow and that's a really bad thing.

the inability of the Congress to accomplish anything continues to grow and that's a bad thing

maybe Jeb will campaign on curtailing executive power and you guys can vote for him, because every President wants to give up powers to the ethical, unassailable Congress

I wouldn't be surprised if we keep an eye them when they eventually return to Afghanistan, and I would imagine that they're under surveillance in Qatar (they can't leave Qatar for a least a year).

I doubt there's any strikes though - we're wrapping it up in Afghanistan and both of the leading candidates in the Afghan elections are looking to negotiate with the Taliban and formally end hostilities. It wouldn't surprise me in the least if these men end up in having some governmental position after we leave.

Gotcha, I'm just going to ignore you from here on out because I can't imagine much intelligent debate happening with you. Good luck on your spin campaign.

And old people are useless in leadership positions, right?

Have their tribes been wiped out?

Uh... what? If you meant "not" security risks... Do you think they will be unable to be briefed on current operations?

You need to change your screen name to "Delusional". These guys are hardcore jihadists, they will NEVER change. All 5 of these guys were classified as "high risk" detainees, too, meaning that the assessment is that there is a high probability that they will return to the jihad upon release. That's why they were not released earlier.

The CIA did not "let them go", the Administration did. The CIA doesn't "let people go" from Gitmo. It's not up to them.

Qatar also has a long history of supporting and funding jihadists in the region. If you think these guys are going to live out the rest of their lives there you're delusional. (that word keeps popping up...)

Oh, so we wanted to return 5 "high risk", senior-level jihadists back to the battlefield? Really?

Afghans Say Taliban Prisoners Freed By U.S. Will Rejoin Battle

    http://www.ibtimes.com/afghans-say-taliban-prisoners-freed-us-will-rejoin-battle-1592903

KABUL (Reuters) – The release of five Taliban prisoners in exchange for a U.S. soldier has drawn criticism from some Afghans, who say the detainees are dangerous and will rekindle ties with terrorist networks to resume fighting, just as most foreign troops leave.

The men had been held at the U.S. naval base at Guantanamo Bay, Cuba since 2002 and were classed by the Pentagon as “high-risk” and “likely to pose a threat”.

Two are also implicated in the murder of thousands of minority Shiite Muslims in Afghanistan, according to the U.S. military.

They were released in a swap with U.S. army sergeant Bowe Bergdahl, the sole American prisoner of war held in Afghanistan who was flown to a U.S. military hospital in Germany on Sunday.

“They will definitely go back to fight, if health-wise they are able to go,” said a top official at Afghanistan’s spy agency, who asked to remain anonymous because of the sensitivity of the topic.

“They will be very dangerous people, because they have connections with regional and international terror organizations around the world.”

Turns out there is a new detail in this whole mess. They actually turned over 10 Taliban terrorists to get the traitor back, apparently they let 5 HVP's go back in August in order to start negotiations to let 5 more go for this kid. Remaining soldiers in Afghanistan better have their head on a swivel because we just set a precedent that we'd give them 10 of their guys for a traitor, imagine what we'd pay for a legitimate soldier.

From everything I've read, the President is completely within the law for all of this. Apparently there will be more.

I welcome the President using Gitmo prisoners to bring home more Americans.

I'll take the word of a constitutional scholar and the DoJ over a CNN Talking Head.

Why are you against bringing back American POWs?
