4 Year Old Can Be Sued

    This judge needs to fired or worse.

    There is way too much litigation in this country.

    This is the like the first case in every torts book. Yes you can sue the kid, no you can't win. It's actually better for the family then letting them sue the parents.

    Its an industry now , and will probably get bigger. What kind of blockhead thinks suing a 4 year old should even be an option.

    Don't see the problem with suing a 4-year old. It's equivalent to suing the parent, who would be paying the tab anyway and is really the one responsible (except for a little added helping of guilt on the poor kid). I think it's weird you can sue a 4 year old, but can't sue a 3 year old.

    They don't say in the article, but I imagine the woman died because of that injury. Mortality rates spike after a broken hip. My grandmother died under similar circumstances -- a clumsy housepainter opened a door into her and knocked her down. She didn't manage to rehab well and couldn't walk anymore; then she needed dialysis and eventually chose to stop the dialysis and die. But no one got sued over it; it was an accident.

    While I agree that Americans are more likely to sue than people in other countries, what about this story implies laziness?

    She actually did die 2 weeks later. The estate is the one who sued the 4 year old. Naturally it's not a criminal suit.

    Yeah. Sorry, I meant that they did not specify whether the cause of her death was related to the hip injury. But, broken hips often lead to death with old people, so I assume it is related.
