    Yes because when somebody in plains clothes pulls a gun out on you, you are going to panic regardless of your sobriety. The police should have called in uniformed backup. Proper police procedure....

    the cop called for backup and asked them to exit the vehicle.

    the drunk driver accelerated and hit a van. cops are not robots.

    I'm unsure. What if they were sober and tried to get away from somebody in plain clothes pulling a gun on them? Would these events still have taken place?

    Who are you to say they wouldn't have responded the same? Do you know them? If not, then you can't say you can only assume. I am unsure and will not say one way or the other because I don't know.

    exactly, I am basing it on general knowledge of doing stuipid stuff while drunk.

    and the general knowledge to not get behind the wheel while drunk

    Dude, you are incredibly dense. This is completely irrelevant because:

    a) You, or anybody else, has absolutely no way of knowing if the incident would have occurred if the victim was otherwise sober.

    b) Cops aren't justified in shooting up somebody for drinking.
