It's the typical put the victim on trial. Even if we accept all of that. Even if Aubery was a serial killer GA law says that a civilian cannot apprehend someone unless they actual witness the crime. None of the evidence including the stories from those on trial show that they actually witnessed Aubery committing a crime.

This morning I saw a young black man running around some storage building wearing a hoodie and had a hand in his pocket. Should I have shot him or just called the police?

Apparently, according to @J.R., you should've shot him because he might've done something some time ago. You couldn't know what that is and you're not the police, but you should make that assumption and fire away.

    Cross posting this from @Reeko

Defense attorneys for the men charged with killing Ahmaud Arbery won’t be allowed to present evidence of the slain Black man’s past legal problems when their clients stand trial for murder, a Georgia judge ruled.

Gregory and Travis McMichael, a father and son, and their neighbor William “Roddie” Bryan Jr. are awaiting trial this fall for chasing and killing 25-year-old Arbery last year as he ran in their neighborhood outside coastal Brunswick. Jury selection is scheduled to start Oct. 18.

Attorneys for the McMichaels wanted the jury to hear about Arbery’s past run-ins with law enforcement, including two arrests, to cast doubt on prosecutors' contention that he was merely an innocent jogger. Defense attorneys say the white men reasonably suspected Arbery had committed a crime when they began the pursuit that ended in his death.

Prosecutors argued that defense lawyers were seeking to put Arbery on trial by making his criminal record and other prior problems part of the case. None of the three defendants knew Arbery, or anything about his past, prior to the shooting. Prosecutors said his past was irrelevant to their decision to arm themselves and ultimately shoot a man who was trying to run away.

In a written order, Superior Court Judge Timothy Walmsley ruled evidence of Arbery's past run-ins with the law could unfairly “lead the jury to believe that although Arbery did not apparently commit any felony that day, he may pose future dangerousness in that he would eventually commit more alleged crimes, and therefore, the Defendants’ actions were somehow justified.”

"The character of victim is neither relevant nor admissible in murder trial,” the judge wrote in his ruling Monday.

The McMichaels pursued Arbery in a pickup truck after they spotted him running in their neighborhood Feb. 23, 2020. Bryan joined the chase and took cellphone video of Travis McMichael shooting Arbery three times at close range with a shotgun.

Defense attorneys argue the three men committed no crimes. They say the McMichaels suspected Arbery was a burglar after he was recorded by video cameras inside a home under construction. Travis McMichael’s lawyers say he shot Arbery in self-defense.

Arbery was unarmed when he was killed. Prosecutors have said nothing was stolen from the construction site and Arbery was merely jogging.

Defense attorneys have also asked the judge to let them introduce evidence Arbery suffered from a mental illness. Walmsley has not ruled on that request.

Arbery pleaded guilty to charges he carried a gun onto a high school campus in 2013, a year after he graduated. Rodney Ellis, police chief for the Glynn County school system, testified at Wednesday’s hearing that Arbery tried to evade officers on foot and stopped only when two of them pointed guns at him.

He was also arrested in 2017 on charges that he tried to steal a TV from a Walmart store. Court records show he pleaded guilty to shoplifting. Arbery was on probation at the time of his death.

Travis McMichaels takes the stand in his own defense.

My guess is the defense in this case is looking to the Rittenhouse trial but these situations are very different. McMichaels and the others deliberately pursued Arbery and sought to capture him. While I still think Rittenhouse had no business being there he was the one being pursued by those he shot.

Unless I missed another thread kind of surprised this trial is getting so little attention here. There's been as much drama in this one as in the Rittenhouse trial especially with moves by the Defense to try to get "Black Pastors" out of the courtroom.

I've been patiently waiting for this trial and snagging updates as they come while I haven't given two ***** about Rittenhouse.

Really curious why it's not getting traction, but whatever, I just want these dangerous idiots thrown in jail.

I think it's because no one is really siding with the defendants. Even the right wing racists think these guys are **** heads and murderers or at least have a hard time defending them.

The Rittenhouse case is more interesting because there is a lot of grey area when it comes to self defense and deadly force. If you look at both side of the Rittenhouse case, you could argue that everybody involved did everything at least legally if not wisely except for curfew violations. I think the dismissal of the gun charge was goofy as F, but maybe the law is written in the books poorly.

Go back and look at this thread. There's a conga line of wingnuts stumbling all over themselves to paint these guys as victims and the deceased as a criminal.

Until the facts came during the trial. Now they are quiet because unless the criminal system is F'ed again, they should get convicted. If not, then this thread will get how again. Right wingnuts hate getting their noses rubbed in losing so when they do, they just change the subject.

Maybe it is that everyone agrees that they are guilty, very unusual for D&D, but still surprised there isn't more comment about the Defense attempting to get rid of black pastors from sitting in the gallery or Travis McMichael testifying in his own defense.

From what I've seen of the cross it looks like Travis McMichael might sink not just himself but also his father and the other defendant.
