Yes and yes. The attempts here weren't to use the legal system. In fact, his attempts to sub in alternate electors had nothing at all to do with the court system. They were literally to commit fraud and/or exert improper political influence. He attempted to use political influence on legislators in other states to baselessly argue fraud and overturning their own state elections, convincing many state reps in both PA and AZ. If he gotten enough, it would have been a Constitutional crisis - and one that did not involve the courts. He's also literally being investigated for calling the Georgia SoS to try to threaten him into "finding" votes. Also, frivolously using the legal system for nonsense lawsuits is illegal, which is why many of his attorneys are now being disbarred for it. Not to mention, of course, trying to get his supporters to invade the Capitol and rooting them on while legislators and his own VP were in danger. You're repeatedly said that all of these things were no big deal or danger to our system. Apparently, people being triggered by it IS the bigger deal. Depends if you have any other arguments like "attempting to do illegal things isn't illegal if it fails".

The odds are still against the Democrats but the last month several issues have moved in their favor. If inflation does come down, or at least stabilize, I think they might have a much better possibility of holding Congress. One thing I am certain is that as in the last few elections we are likely to see Democrats get more overall votes than Republicans even if Republicans win Congress because of how gerrymandered things are.
