Ah yes, the Turner diaries. I remember. Like I said, I don't think he joined or belonged to a group that was militarily striking at the U.S. which Awlaki had done. A confirmation from Al Qaeda itself came after his death. I agree that fighting terrorism should be carried out differently than fighting a traditional war, but I also believe that enemy combatants who join Al-Qaeda while they are engaged in military combat with the U.S. are subject to being attacked by the U.S. military. I don't think that in itself is an expansion of executive power and has been pretty standard. I'm totally against assassinating U.S. citizens, unless they are actively belonging to a group which makes violent military strikes against the U.S. and promises to continue to do so.

You are ignoring the fact that was a Congressional Authorization of Force against Al Qaeda which is the equivalent of a declaration of war. To my knowledge no such authorization was made against Pierce and his organization.
