This is very sad. I wonder how old the mother was, she was probably young and irresponsible. Why would you, a) leave a gun anywhere but a safe, b) if not in a safe, anywhere even remotely within the reaches of a child, c) have it sitting there loaded (if it was on the wall I'm guessing it was on display, so no reason to have it loaded in the first place.

There should definitely be some type of charges against the parents. Anytime a firearm ends up in the hands of a child and something like this occurs, charges should be filed. Even if it's community service, neither of the parents should just be let off that easily without even a slap on the wrist. Child protection agency should put the child in a better place until the parents attend some classes. I would hate to do that to the child, but I would think it's for everyone's best.

Fill in X with infinite. If they're this demonstrably stupid, they're not going to suddenly get smart. Ever.

It would be nice if people were FORCED to buy safes when they buy the guns. I'm sure a lot of people would just sell them off, and I'm sure there would be times when people leave them out, but I would think most would actually use them since they paid for them.

The original article said the gun was in a case. I am wondering what sort of case? Was it a small gun safe that wasn't locked, a holster or just a box?

At the risk of moving this to the D & D I imagine if this were proposed that there would be people arguing that the Constitution doesn't restrict the rights of stupid people.

Unfortuantely, that's correct. The Constitution protects the rights of everybody, even stupid people. That's democracy's major flaw. We assume everybody has some level of intelligence.

I thought this was legal in East Texas.
