Southwest Kia of Rosenberg - My girlfriend's car was stolen by this dealership

    Crazy stuff. I hope you get the car back and they will have to pay dearly.

    Back in 1995, there was this law professor at my law school who had sort of a TV show, Alderman or something? Is this guy still there? Maybe also a way to get some publicity.

    Oh, and is this guy that calls himself the "tough, smart lawyer" still alive? :)

    I found this. Apparently the dealer has the right to cancel a contract within 10 days, which is unbelievable to me.

    It is based on the language of the purchase contract. Look at your purchase contract. That’s the long yellow document that says “RETAIL INSTALLMENT SALES CONTRACT” at the top. Turn to the back of the purchase contract, and find the box that says “Seller’s Right to Cancel.” It is at the bottom of the second column. Car dealers are in the business of selling cars to consumers, not financing cars that consumers buy. So, this box advises you that after you sign the purchase contract and leave with the car, the dealership is going to find a finance company or bank to buy your contract. "

    This just lets them pull shady crap like they did with you. Personally, I've had pretty bad experience with dealers. Can't stand them.

    Very sorry to hear about this crap, that just disgusts me, makes my blood boil.


    I've seen a bit of the car sales business though, and you have to be a real pond scum ****rag to stoop to the level some of these urchins gladly stoop to on a daily basis.

    Actually, it isn't.

    I just reviewed the entire contract, as my brother did earlier tonight, and no language bearing any resemblance to any seller's right to cancel (or even anything like that, unless the buyer defaults) appears anywhere in the Retail Installment Sales Contract I hold in my hands. Or anywhere else in the rather large pile of paperwork we have, all of which is signed and dated by the dealer.

    I'm sure they were hoping to retrieve our copies of the contracts when they took the car, but we had the presence of mind to bring them inside our house when they started threatening us.

    Theres a good chance he's just doing it because most of the people he's ****ed over he knows probably don't have the means to afford excellent legal representation to take appropriate steps to sue them.

    Everyone who is really a lawyer should call up this doucherat's number and blow up his phone with messages and every one of them should mention how they are part of the Batman Jones all-star team of Lawyers, as they are all working the case Pro Bono because Batman himself asked them to because he's ****ing Batman Jones and they were like "well yeah we'll do it, duh but we better at least get lemonades" and then BJ would be like hell yeah man I'll bring you a big pitcher of lemonade as long as you squeeze this lemon-hocking son of a panda testicle for all he's worth.

    I found some other non-California sites that said similar stuff, but if it's not in the contract then I don't see how they can get away with it.

    That is why when I buy a car I work out financing with the credit union then just call around the various dealers to find the one with the specs I want in stock.

    I let them bid against each other and all I do is make some phone calls. The one that goes the lowest gets a visit from me.

    Unfortunately there is no escaping the "other office" where they try to sell you low jack and undercoating or whatever. Jerks.

    That "slightly increased" rate was an additional $2,400 for the term of the note. That put you into a possible new car price payments territory, which has chances of a lower APR. Which allows you to get a more expensive car but pay the same amount as you would for a used. In addition, give you the full factory warranty on a new car (the warranties that you were looking at already had a -30,000 miles against them). This goes towards my belief that a new car can be a better value than used. But, that's all contingent on your ability to get a good rate.

    The part that I don't understand is that it's not like you got an excellent deal. The 10/100 warranty sounds like a powertrain warranty (eventhough Kia's come with a 10/100 pt warranty). The starting MSRP of a Kia Rio is $12k, it has 30k miles, so drop the money for being used -$2,000, drop the money for having a lot of miles for one year -$1,000. Your total loan payments is $14,280, on 10% that's about $11,500 principal.

    It's not a bad deal, but not an excellent deal; unless the warranty is a good bumper to bumper warranty in which case, if the car was nicely equipped it could be a decent deal for you.

    My guess it's more of them trying to squeeze more money from HER, since they talked her into more stuff after your left.
