See, it doesn’t work like that either. The Third circuit affirmed the district courts dismissal. It did not “kick it up to the Supreme Court “ in any way. The trump team must then file a petition for writ of certiorari to ask the USSC to grant review of the Third Circuits ruling. See the thing is, cases do not automatically get reviewed by the USSC. Otherwise it would be flooded with appeals from across every circuit in the country. It must grant review.

Also,it is both stupid and incorrect to say “this is where they wanted to go”. The relief sought at the Third circuit was a ruling that the district court erred in not allowing team trump to file yet another amended complaint and a remand to the district court with instructions to allow the amendment. The relief sought, if the USSC grants review, will be that very same ruling and very same remand. Losing at the third circuit is not “where they wanted to go”.

Lastly, you seem to miss the key point or just refuse to acknowledge it. A remand is not some form of victory. Rather — and read this carefully - it’s a do over. A chance to not lose the case again at the earliest stage possible .... namely, dismissal for failing to file a comprehensible legal claim with sufficient allegations to articulate a claim.

It is both stupid and incorrect to suggest that team trump wanted to lose at the Third Circuit, so that they could go to the USSC. You need to stop reading dumb headlines and understand how actual court proceedings work.

He wanted it to go there because he's an idiot and, like you, doesn't understand how courts work. It will be interesting to see his reaction when the USSC either rejects the case or rules 9-0 to affirm the lower court decision.

Why wouldn't they want to win the first court case and have a victory? Why did they want to lose?

I already said I expect a Biden presidency. I won't be shocked. Yall wanna have a court case before it happens because yall deeply want to feel safe.... because Biden still is not the president elect.

    Sure.

But that is getting way outside of this thread's scope.

The fact remains that Biden... is still not the president elect.

I want you to know that although dachuda is unworthy of the good-faith effort you're putting into this, your educational posts are great reading for me, and I suspect many others as well. Thank you, and good work.

You didn't answer my question. Have you notified OAN and Newsmax (in addition to most every single news organization in the USA) telling them their reporting is wrong?

Except, of course, that he is, according to US law (Presidential Transition Act of 1963, Presidential Transitions Effectiveness Act of 1998, Presidential Transition Act of 2000, Pre-Election Presidential Transition Act of 2010).
