    1) not sure if quoting past statements rises to a constitutional argument?
    2) is it up to the judge to decide if the ban is actually needed?

Will be interesting to see this play out if the administration does indeed appeal all the way up.

    1. I believe the past statements are used in establishing intent. Trump's argument is that the order isn't a religious ban. The judges are using his own statements, along with other advisers and government officials, to establish that the bans are targeted to a specific religion.
    2. The judge wasn't deciding whether the ban was actually needed, but quoting a government analysis that the ban was not needed. I suspect that the judge did so to measure the benefit versus impact of the ban.

Start with the Muslim. Easy target, driven by fear.

Then next, those that he think doesn't have American values. Of course, only Trump and Bannon's version of American values. Not that hard a target, to be driven by right wing religious values.

    http://www.cbsnews.com/news/donald-trump-says-hes-expanding-muslim-ban/

Donald Trump said Sunday that the proposal to suspend immigration from any nation compromised by terrorism is actually an expansion of his plan to block Muslims from entering the U.S.

In an interview on NBC's "Meet the Press," the GOP presidential nominee was asked to clarify what he meant in his speech accepting the nomination at the Republican National Convention in Cleveland last week and if it was actually a rollback.

"I don't think so. I actually don't think it's a rollback. In fact, you could say it's an expansion. I'm looking now at territory. People were so upset when I used the word Muslim. Oh, you can't use the word 'Muslim.' Remember this. And I'm okay with that, because I'm talking territory instead of Muslim," Trump told "Meet the Press" host Chuck Todd.

In Cleveland Thursday night, Trump said that the U.S. "must immediately suspend immigration from any nation that has been compromised by terrorism until such time as proven vetting mechanisms have been put in place."

Trump added that he only wants to admit people into the U.S. who supports American values and loves Americans.

It's not the first time Trump has characterized his plan this way, which sounds like he could even suspend immigration from countries like France, Belgium and Turkey, which have suffered from terror attacks over the last year or so.

Trump first called for a "total and complete shutdown" of Muslims entering the U.S. early last December, a few days after the San Bernardino terror attack.

You have to understand that America has become a nation of p*****s. This explains why everyone is afraid all the time, including our president.

Trump's latest end run now that his second Muslim ban has been stopped by the courts? Note the bolded part, showing its really targeting Middle Eastern and African visa applicants...

Report: State Dept. orders stricter screening for visa applicants

It's as if Trump has a superficial child like understanding of the world with no principles and just agrees with the last person who either says nice things about him or uses bigger words than him.

I'll wait till the facts come out here. There has been a lot of false flagging going on lately on BOTH sides of our political paradigm.

Tillerson and Exxon probably had a hand in the Saudi exception. You know oil deals that caused this during the days of Bush-Cheney.

Or maybe we should check if Trump has a current hotel deal going in Saudi or if the Saudis are reserving massive blocks of rooms at Trump hotels somewhwere.

But seriously though: wouldn't it be funny if some of the Syrian refugees that we banned got hit by one of our cruise missiles? They'd be all like  and we'd be all like :D

2 out of the 7 countries have a combined 10 million people on the brink of starvation. Others, such as Sudan and Syria are also experience food scarcity.

Should the US accept all of the afflicted? Many of the neighboring countries are unwilling to resettle these afflicted people. Kenya, for instance, has housed Somali refugees in, what is effectively now, their third largest city: a giant refugee camp.

Despite 21st century education, infrastructure, and technology, these countries and other regions of the world are using these devices to further extreme ideologies - not to rebel against them. I think you have to consider refugee resettlement through the viewpoint that these countries, and other parts of the world, will continue to experience this level of violence, r****dation, and humiliation for much of the century.
