That's the beauty of the impeachment power -- it is whatever the House says it is. :D

This is now the main plank of the Republican party. All those fringe far right members of the 80's have hijacked the party that actually used to think of others as well as themselves. Orin Hatch can pound sand. He was a terrible politician that only worked to get reelected his final 10+ years. He did nothing and has contributed to this dysfunction as much as anyone else. Something about rocks and glass houses here.

Honestly this is the most Un-American attitude I can think of. Why try. Disgusting.

Are you asking if the House exercising the power vested exclusively in them in the Constitution is an abuse of power? I'm not sure that's possible. Anyway, in a bi-cameral arrangement like we have, the Senate is the check on the House because a law or an impeachment has no execution without the Senate's approval. So don't worry, our forefathers already took care of it.

You basically said it really doesn’t matter if the Dems make up the rules as they go there are checks that keep them from getting away with it or did I misconstrue?

I'm saying the Constitution leaves the impeachment and Senate trial process largely undefined, so it is up to those two bodies (and the Chief Justice and precedent) to decide what and how to impeach. In the execution of their powers, the House is checked by the Senate and the Senate by the House; both bodies must agree for a president to be removed, so there is no risk of one chamber abusing its power to unilaterally remove the executive. And these bodies are also empowered to police themselves because they can expel individual members they find to be corrupt or otherwise unfit.

We would still be at risk of an abuse of power if the two bodies were willing to cooperate with one another to some evil purpose. There is also such a risk if the Senate were to conspire with the Executive, or the Executive with the Judiciary. We have an arrangement where the branches of government check one another, but it isn't impossible to overcome either. In this situation, there is plainly no conspiracy between the House and the Senate though, so I don't see any risk of an abuse of power by the Legislature in this exercise.

But, you'd say, the impeachment itself even without conviction is something the House can do unilaterally that can hurt a president. Yes. It's clearly built that way in the Constitution, so it seems hard to say its exercise can be called an abuse. The remedy, I suppose, is the election, which comes frequently for House members.

So, to get back to your question. The House must make up the rules as they go (with reference to House rules and precedent), that's their job -- including deciding what is impeachable conduct. If they're out of line, they can be blocked by the Senate. As it turns out, even if they're right they can be blocked by an out-of-line Senate. Depending on your perspective, we expect to see one or the other in the next few months.

Dude wayyyyyy too many words and valid factual arguments. Keep it in the 1-4 word slogan for it to sink in. Think "Witch Hunt" "Lock Her Up" "What about Benghazi" "Build the wall" " Make America Great Again" or " Keep America Great" Simple and to the point. Shallow intellectually as a puddle on the sidewalk but still, thats what this type is looking for.

If you post this many words you are more likely to be ignored entirely because reading is hard. I have found it interesting that posts like this get swept under the rug all the time here in D&D. Ignore what you dont like or what kills your talking point and just move to something else, or focus on one phrase in the post and turn it into a debate about semantics.
