This is why gun control is badly lacking. Too easy to claim stand your ground and shoot someone when emotions are high. Basically neighbors having a dispute and one woman goes to knock on the door of the other, and the other shoots them through the door and claims they were standing their ground. The woman was unarmed that was knocking. https://www.cnn.com/2023/06/05/us/florida-woman-aj-owens-fatally-shot-neighbor-feud/index.html
Sounds like murder. I've come to really hate the stand your ground laws. Not just because it obfuscates guilt or emboldens people to be unnecessarily violent, though it does those things, but also because it asks police to make a judgement on whether the violence was justified before even posing it to a court. I'd prefer a system where the cops say, 'you pulled the trigger so you're spending the night in jail,' and self-defense could be an argument your attorney makes at trial -- and maybe the prosecutor drops the indictment if they expect the self-defense argument to be too strong. But the way stand your ground laws are written is too generous to criminals' presumption of innocence.
so the neighbor had called the victim’s family racial slurs and harassed them for playing outside, and now shoots her through the door I’m sure the scary black person defense will be used
When I saw the shooter was unnamed. . . . I figure they are not a minority News papers, Cops and klansfolx always protect the murderer in these type of cases. Rocket River
Not in Florida. I knew before I clicked on the link to the story exactly where it originated from. If only Bugs Bunny and his large saw could really cut that state off and let it float away into the Bermuda Triangle.
Stand your ground and self defense always get used to kill someone in cold blood. Can't really refute the story the "victim" spin when u are dead
I fully agree and have raised this criticism they Stand Your Ground very much muddles the nature of self defense. In this case it even sounds like it’s being misapplied as my understanding of the FL Stand Your Ground is that a threat would have to be established. That LE can’t even bring the shooter in custody doesn’t match other cases such as the Trayvon Martin case where Zimmerman was initially arrested. This case though seems more like a castle doctrine case since the shooting was in the property of the shooter. I still think this would be a misapplication as you would have to prove that the mere act of knocking on a door is a threat.
Of Course. When anyone commits a crime they try to justify it. Im not sure why anyone in this thread is getting upset. Nobody is disputing this is murder except the murderer.
IMO this is murder, I am all for people defending themselves but in this case shooting through a door is not self defense.
this sounds almost as bad as the guy who shot that black kid several times through the door just for accidentally knocking on the wrong place
She has now been arrested. On the one hand, you're right people are getting ahead of themselves expecting the worst from police. On the other hand, the way police have to delay an arrest because of a pretense of self-defense is goading. There is a sense of justice delayed is justice denied. Probably justice system peeps don't see it as a big deal because its just a little hiccup in one step of processing someone through arrest, indictment, trial, conviction, appeals, and incarceration. But for public perception, knowing someone just perpetrated a homicide and then go sleep in their own bed just isn't going to go down easy. Her name is Susan Lorincz.
