Thanks for asking. In light of today's statement made by the NFL VP of Security, I am actually more certain of it today than I was yesterday. § 22.01. ASSAULT. (a) A person commits an offense if the person: (1) intentionally, knowingly, or recklessly causes bodily injury to another, including the person's spouse; (2) intentionally or knowingly threatens another with imminent bodily injury, including the person's spouse; or (3) intentionally or knowingly causes physical contact with another when the person knows or should reasonably believe that the other will regard the contact as offensive or provocative. (c) An offense under Subsection (a)(2) or (3) is a Class C misdemeanor, except that the offense is: (2) a Class B misdemeanor if the offense is committed by a person who is not a sports participant against a person the actor knows is a sports participant either: (A) while the participant is performing duties or responsibilities in the participant's capacity as a sports participant; or (B) in retaliation for or on account of the participant's performance of a duty or responsibility within the participant's capacity as a sports participant. (e) In this section: (4) "Sports participant" means a person who participates in any official capacity with respect to an interscholastic, intercollegiate, or other organized amateur or professional athletic competition and includes an athlete, referee, umpire, linesman, coach, instructor, administrator, or staff member. In such cases, NFL Security conducts its investigations based on information it receives directly from teams (i.e. Houston Texans) and not from media (i.e. Sports Radio 610). It should also be clear that the Texans received their information from Matt Schaub (or his representative/agent) and not HPD. Make no mistake, this is a serious matter. And, if you don't believe Matt Schaub, the Texans and/or the NFL will press charges against this individual (should they apprehend the perp) -- thereby making an example of him/her -- then there is nothing else for us to discuss.

I will attempt one more time to explain this...... Going to his house was inexcusable and over the line - there is no point I made that said that was ok....it is not. The courage quote was a joke about Kubiak not having the balls to bench Schaub. Now please stop overreacting and transferring your anger about what these knuckleheads did to me. I would not condone it, think it is stupid - and dangerous. DD
