Here's the situation. I bought a car from Champion Scion this saturday. We agreed on 10,900. We I was signing papers for financing, the dealership put 12,994 on accident or on purpose...who knows. I just looked today, am I screwed? I have not paid my down payment yet....what are my options?
Are your sure it isn't 10,900 plus various fees, warranties, insurance and taxes? That would actually be very much in the realm of possibility. Or if there was a rebate and you agreed to an amount they usually try to say your amount included the rebate even if it didn't. If you are sure that it is wrong, I suggest doing the following: If the bank hasn't sent the dealership the check, call them and tell them not to send it. If they have, then you have to talk to the dealership.
Yeah, they don't have a way to get the downpayment, because I was going to do it by credit card and they don't have my credit card info. No, I'm pretty sure 12994 is the selling price. Fee's are itemized later on in the contract.
trust me, it's not an accident. they do that hoping you're ignorant and totally oblivious to what's going on. just like they did to my sister and her husband. they got screwed big time b/c they didn't know any better. read the thread i started about it.
Talk to your salesman. He's the one you negotiated the price with. He's the one who has the most to lose because it's his commission. Odds are it is just an error. Otherwise, you need to get out of the deal.
Doubt it. If you think it's the best deal you can get then talk to them and get it corrected. But if it were me I know I'd able to get a better deal elsewhere... and more importantly, with a more honest salesman.
I somehow ended up signing two different contracts without me knowing it. The one they gave the bank for my loan amount was higher than the one they gave me by about $1,000. The same dealership has to replace my stepmom's car because it turns out it was a lemon, and they've been unable to fix it. Considering that the Honda dealership did a great job with both me and my dad, I would prefer to buy all my cars from that dealership in the future. It is a combination Nissan/Hyundai dealership that sucks. They also have the Chevy & Ford dealerships in town too. Most of them a crooks, and that is very sad.
I actually know somebody that went through something similiar. His friend knew of this dealership. His friend had told him to call the dealership up, and asked for some high level manager. Then, he told him that the Texas Attorney General would be very interested in this deal, and that the attorney general would have this paperwork and his name as a contact to call. The manager had some low level employee give him a full refund and void the contract. Then, the employee escorted him off the premises. LOL. Maybe this guy had been in trouble before. You could try the same thing. I don't know if it will work.
Somewhat similar thing happened to me. When it came to signing, they added the extended warranty, gap insurance, and other BS I didn't want. Luckily I caught it before I signed. So I wouldn't be suprised if they pulled this. Man, I hate dealers.
Are you sure you are not financing 12,994, which would be the 10,900+interest over the time of the loan? Because you have the borrow the amount to cover both the principal and the interest which would be 12,994 presumably if its legit.
my credit union even tried to sell me on that. Would not stop, I told them twice that my down payment made it so there is no "gap" the car is worth more than what I owe, by several thousand. "I dunno, it's a good thing to have!"
There was no mutual assent as to the $12,000+ price tag so there is no contract. There was mutual assent to the $10,000 price tag, thus there is only an enforceable contract only for that price. (That is what I have gotten from my 3 weeks of contracts!)
4 corners of the contract. better go in there real "PISSED OFF" threatening all kinds of press coverage if they don't explain what's going on.
You're probably right, unless he can prove a misrepresentation. It'd be a DTPA case though, so getting a lawyer on contingency isn't out of the question given there's a chance for legal fees.
