You people have been spewing this kind of rhetorical diarrhea for over two straight years now and all it does is stink and look nasty coming out of your mouth.

Great tweet, it's good to see well-sourced tweets from reputable scholars like Laurence Tribe, as opposed to daytime TV talk show lawyers like the Dersh.

 

Everybody can have an opinion.

The question is how much weight should be given to the opinion.

If you are not a lawyer, you legal opinion should not carry much weight.

The legal opinion of a law professor, concerning an area of their expertise, would carry weight. The consensus of a group of law professors would carry more weight.

 

I guess it only depends if you are for or against trump. Since it appears Tribe (a trump critic but a professor of law at Harvard with a focus on constitutional law) appears to be questioning the legal basis that dershowitz (a trump supporter) is saying trump has "due process right to make an simultaneous rebuttal". Since dershowitz has been advocating for trump (unofficially) I'd be more suspect of his positions... but, again, it would seem he could have cited legal precedence for his claim.

 

Why not just prosecute? Why hold it in reserve? The state AG may change, the governor might cut some political deal, and the opportunity is gone. If you have charges, just bring them.

Perhaps more to the point, even to a layman Dershowitz's argument sounds dumb, and Tribe's criticism of his argument sounds on-point.

There is nothing that I am aware of that gives the Trump administration the right to withhold a report until they have time to write a rebuttal.

They have the right to write whatever they want at anytime they want, but there is no mechanism that says a report or finding is to be held so that it is released concurrently with a rebuttal. There isn't even tradition for such a procedure as far as I know.

Dershowitz knows this too........ he just likes to throw things out there.

I was a federal prosecutor for years (granted it was years ago) and the claim made by Dershowitz is essentially made up from what I know.
