you could almost argue standard sobriety tests should be irrelevant in a situation like this. I could be completely sober, it could be 0% my fault and 100% the victim's fault, but still, if someone jumped out in front of my car, I hit him and they are seriously injured/dying...well, I might not be perfect on any test given right then. have to wait for the blood results. sad situation all around.
Blood-alcohol is probably not a great indicator of driving impairment here. The alcohol was probably out of his system, but he probably wasn't in top form after drinking the night before, and getting back on the road early after not enough sleep. Of course, the law doesn't address that.

Pretty sure that if you're legally drunk, nothing else matters. That's one of the reasons why you should never blow.
Thing is, I thought they said something about him possibly not having a way to avoid the guy. Something about a median and/or construction, that, if he would have swerved, he would have wrecked himself. I think that could become a factor in this thing, and somehow, I think he gets out of it with a DUI charge. A little jail time (probably similar to the 90 days Leonard Little got) and a long time of probation....
Not trying to make any excuses for Stallworth, but on MacArthur there is almost never any pedestrian traffic. I'm surprised to hear a pedestrian accident happening there. And I'm guessing he went to a club downtown (there's a club scene there too, although a bit more spread out) and has a condo in Miami Beach that he was going back to.
Yes, you are supposed to look both ways. And if there are no vehicles nearby, you can cross legally in a crosswalk. If someone then comes driving up after you are already in the crosswalk, they are required to stop. They can't just run you down because you were in the street, and the street is for vehicles.

Two people said an arrest warrant charging the 28-year-old Stallworth with DUI manslaughter will be filed Wednesday in the March 14 accident that killed 59-year-old Mario Reyes. The people requested anonymity because the charges haven't been announced. Stallworth The charge carries a possible 15-year prison sentence. Stallworth's blood-alcohol level after the crash was .12, well above Florida's legal limit of .08, according to results of a blood test. Stallworth will also be charged with DUI, according to the people informed about the case. Stallworth, who is expected to surrender in court Thursday, released a statement after the incident saying, "My family and I are grief-stricken over the tragic accident which occurred Saturday on Miami Beach where Mario Reyes sadly lost his life." He returned to Cleveland and has been working out with the team, which Miami Beach police were aware of, according to Stallworth's attorney, Chris Lyons. A Miami Beach police report said that Reyes was not in a crosswalk on busy MacArthur Causeway when he was struck by the Bentley luxury car driven by Stallworth. The construction crane operator was trying to catch a bus home after finishing his shift about 7:15 a.m. The report also quoted Stallworth as saying he flashed his lights at Reyes in an attempted warning and that Stallworth was driving about 50 mph in a 40-mph zone. Stallworth signed a seven-year, $35 million contract with the Browns before last season but was injured much of the year. He previously played for New England, Philadelphia and New Orleans.
