NJ cop involved in fatal accident had BAC 3x legal limit

The New Jersey cop who lost two friends when his car crashed into a tractor trailer while going the wrong way on a Staten Island highway was heavily intoxicated when he got behind the wheel, officials said Friday.

Officer Pedro Abad Jr.’s Blood Alcohol Content following the fatal March 20 crash was .24% — more than three times the legal limit, NBC New York reported.

Abad, a six-year veteran with the Linden N.J. police department, crashed his Honda Civic head on into a tractor trailer during the 4:51 a.m. crash on the West Shore Expressway. He ignored four traffic signs and went the wrong way on the highway as he and his friends left Curves, a Staten Island “gentleman’s club” featuring topless dancers, police said.

Killed in the gruesome crash were Linden Police Officer Frank Viggiano, 28, and fellow passenger Joseph Rodriguez, 28, officials said. Linden cop Patrik Kudlac, 23, was critically injured.

Abad was also critically injured and remained hospitalized Friday, officials said.

Neither the police nor the Staten Island District Attorney’s office would comment on Abad’s blood-alcohol content.

Detectives got a warrant to test Abad’s blood after the crash.

The legal blood alcohol limit in New York is .08%. Having a BAC level of .24% is equivalent of a 140-pound man having nine alcoholic drinks, officials said.

No charges have been filed against Abad, police said Friday.

A Staten Island grand jury may weigh the evidence against Abad next week to see if he should be charged, law enforcement sources said.

Hours before the crash, Abad posted a photo of four shots of whiskey on Instagram from a Roselle, N.J., bar.

“Here’s to finding that which we all hope for,” he wrote beneath the photo of three glasses filled with 70 proof Jack Daniel’s Tennessee Fire.

FYI, the driver had had a previous DUI dismissed after he crashed through a freaking store:

The charges, filed against Pedro Abad Jr. after a Jan. 22, 2011 accident in which he crashed through the wall of the Roselle store, were dismissed nearly a year later because the evidence, including State Police reports about blood-alcohol testing and tapes of police transmissions, had not been turned over, as Municipal Court Judge Carl Marshall had ordered.

Given that I grew up in the great state of NJ, I felt like I should post this one. Definitely a little different than the cop stories currently dominating the media, but any debate about the problems facing -- and caused by/exacerbated -- LEOs in this country should probably include a discussion about alcohol abuse.

We should probably also talk about the idea of "professional courtesy". It sounds like this dude was a habitual drunk driver, and I can't help but wonder how many times he's been pulled over by a fellow LEO and got off with a warning thanks to his badge.

It also blows my mind that two other cops got into the car with this guy.

Given that I grew up in the great state of NJ, I felt like I should post this one. Those officers knew the law but they got in the car with a cop who was breaking the law... It is what it is.

I see why cops think they are above the law. This cop and his cop buddies that covered up his first DUI should go to jail. I bet if that thin blue line didn't get him out of the first one then this wouldn't have happened and those passengers would still be alive.
