mar1juana Legalized in 2 States, Gay Marriage in 4. Is Slavery Next?

    mar1juana was legalized in two states yesterday, and 4 states voted to approve same sex marriage. 10th Amendment. States' Rights. Surely, slavery and Jim Crow are soon to follow in Washington and Colorado. :eek: :eek:

    What is the Obama Admin response to this?

    DEA Responds to Legal Weed in Colorado and Washington: "Enforcement of the Controlled Substances Act remains unchanged"

    Despite the passage of ballot initiatives in Washington and Colorado legalizing recreational mar1juana, "the Drug Enforcement Administration’s enforcement of the Controlled Substances Act remains unchanged," a DEA spokesperson told Reason this morning.

    "In enacting the Controlled Substances Act, Congress determined that mar1juana is a Schedule I controlled substance. The Department of Justice is reviewing the ballot initiatives and we have no additional comment at this time."

    The DOJ released a similarly opaque response to reporter CJ Ciaramella of the Washington Free Beacon. "The Department's enforcement of the Controlled Substances Act remains unchanged. In enacting the Controlled Substances Act, Congress determined that mar1juana is a Schedule I controlled substance. We are reviewing the ballot initiatives and have no additional comment at this time."

    While there's "no comment at this time," Deputy Attorney General James Cole hinted last month at what the Obama administration's response might be.

    "Each case is going to rise and fall on its own unique facts," Cole said in a 60 Minutes interview. "Any of that is still in violation of the Controlled Substances Act of the federal law. We're not interested in bothering people who are sick and are using it in the recommendation of a doctor. We are concerned with people who are using it as a pretext to become large-scale drug dealers."

    Colorado Gov. John Hickenlooper, an opponent of Amendment 64, had this to say late last night: “The voters have spoken and we have to respect their will. This will be a complicated process, but we intend to follow through. That said, federal law still says mar1juana is an illegal drug so don’t break out the Cheetos or gold fish too quickly.”

    Sure, I mean logically, giving people the right to marry who they want and smoke a plant will surely eventually lead to the inevitable return of slavery.

    Rtsy, i understand frustration because your guy lost, but relating any of this to slavery is ridiculous. Really?

    I guess I shouldn't expect anything less from you, considering your history of disrespect towards minorities and anger that you have a black president.

    Move on. Wait 4 more years and you can try again.

    Have any of you self-righteous constitutional junkies read any part of the document aside from the 10th Amendment?

    Never mind that the U.S. participates in several international drug treaties.
    Never mind that until the U.S. withdraws from these treaties, the CSA remains constitutional.
    Never mind that as long as the CSA remains consitutional, the Supremacy Clause allows federal drug laws to supercede state law.
    Never mind that it's the DEA's duty (as an agency of the executive branch) to choose the rules by which to enforce the CSA (a law passed by the legislative branch).

    Forget about all that other stuff written in the constitution! 10th Amendment! States' Rights! Obama be the unconstitutional debil who will enslave us all!

    ...you do know that the DOJ is refusing to defend DOMA, right?

    That partly has to do with federalism implications.

    Hopefully all 50 states wake up some day.

    He doesn't really have that thought. He's just trying to make a ridiculous argument as a way to make it look ridiculous that they legalized these two things.

    People just need to be called out for this crap. If you're comparing legalizing gay marriage and mar1juana to legalizing slavery, you're stupid. No, you don't just have a difference in opinion or it's not that you're taking the other side of a controversial issue. If you truly believe that those two things are analogous, you are literally stupid.

    mar1juana is currently a federally controlled substance. Colorado law enforcement agents might not be able to restrict its use, but federal thugs can come in at any time and arrest anyone growing/using weed. Blame the supreme court and their continued use of the interstate commerce clause to limit our freedoms.

    I think he's trying to call out the people who equate state's rights with slavery. I don't think he's saying because there's gay marriage we will soon have slavery. At least I hope not...

    Mention nullification to some and you might as well be wearing a white robe with a pointy hat.

    5-4, GOP. Not that it means anything, since both parties have similar stances on mar1juana (opposition with a few in the far-ends supporting legalisation).

    However, much of the court is elderly. I wouldn't be surprised if Ginsberg, Scalia, and Kennedy retire during this term. In which case, the Dems would take the court 6-3.

    International treaties can not trump the constitution. International treaties have nothing to do with the constitutionality of the CSA.

    True. However states can choose not to enforce the CSA. The federal government would have to send in agents to enforce the law.

    Unfortunately true.

    Lol. The constitutionality of the CSA is being held up like most bad federal laws through a tenuous interpretation of the commerce clause.

    Why are the conservatives on this board so far on the right? The democrats are spread out on the liberal spectrum but almost ALL republicans are on the extreme end.

    because if you're not extreme right to these people, you're not conservative. and if you're not conservative you're a liberal. this is of course according to a lot of pundits.
