    Hypothetical situation here. If a gas station owner in an isolated area wants to discriminate and not serve Black people and a Black couple with a quarter of a tank left would be stranded if they are denied service at this station, should the owner have the right to discriminate and not serve the couple?

    I mean we could solve this dilemma with Google updating their Maps app with filters that have options such as "businesses that serve African Americans" or "businesses that serve Muslims".

    We didn't legislate away private discrimination. We legislated away discrimination if you want government benefits that come from owning a business (tax deductions, licensing, etc). If you're going to run a business, you have all sorts of requirements, ranging from office safety to health inspections to who you serve. In exchange, you get to deduct expenses, a seal of approval from the government, and a whole host of other benefits.

    If he was just a private seller of guns instead of being a business, he could discriminate however he wants.

    Funny...the guy is an idiot at best and at worst wants to start a war.

    Concerning treasonous insurrectionists the US Congress didn't think so when they voted to give Confederate war veterans benefits or when US military bases and sites were named after Confederate war soldiers... Or former confederates that were deeply involved in politics and buisness after the Civil War.. Or that many of the current U.S. soldiers are from former Confederate states and had great great grandfathers that fought for the Confederacy.

    If you want the Confederate flag taken down and socially looked down upon because it seems that every ******* that thinks they are social or racially superior flies it, so be it (although I find it in states that did not join the confederacy... It is all over Kentucky and Ohio and rural Illinois)....

    This is an important distinction that is often over looked or misunderstood. Thurgood Marshall was the first African American on the Supreme Court and believed that a true private organization should have the right to limit membership and pick their criteria.... But that doesn't mean Wal Mart should be able to keep out women or Muslims or Mexicans. A real true, private club/organization is different.

    It's exactly Jim Crow, especially if you consider some of the postwar rationale regarding hygiene and miscegenation offered up once the rest of the country started questioning their policies. Lawyers don't work for free or to lose, so until a meaningful test case comes up and you get local, individual muslims who are more concerned about social justice than complicating all the other non-discriminatory relationships or activities these vendors are in the clear. This is the logistical advantage case-by-case discrimination has that a lot of isn't always appreciated.

    So, basically he's going to be doing the skin and beard test to determine who is Muslim and who isn't? What about the white and black ones or converts? What if the Muslim shaved his beard to blend in and is wearing a suit?

    There are groups out there like CAIR that would probably be willing to take this on in a lawsuit. Barring a lawsuit though I'm wondering if this would be grounds for the municipality to remove his business license.
