The lawsuit was filed Tuesday by a lawyer for Michael Ray, who followed the Bosh family from California last June when moved into a nine-bedroom, five bathroom mansion along the Colorado River in Austin’s Steiner Ranch community. In the course of the move, Ray says Bosh terminated two people who managed the family’s household in California and appointed Ray to handle the duties that they had filled, such as taking care of the family dogs, assembling furniture and taking out the trash. Ray kept his role as Bosh’s driver, and sometimes logged 70 work hours per week, the lawsuit states. But Bosh refused to pay for hours Ray worked past 40 hours in a week, the lawsuit says. At the time of the move, Bosh had moved Ray from an hourly wage to a fixed salary and believed the new set-up exempted the assistant from overtime compensation, the lawsuit states. Ray complained to Bosh in November and was fired less than three weeks later, according to the lawsuit. Bosh, who played 13 NBA seasons with the Miami Heat and Toronto Raptors, could not be reached for comment Wednesday through the agency that handles his booking requests. A lawyer who is representing Ray, Daniel B. Ross, said Bosh should have paid the assistant time-and-a-half for every hour he worked past 40 hours.
I'm on salary and there is no such thing as overtime pay on salary in our job. He could have asked for a raise for the extra duties or more clearly define roles but suing seems like another person trying to make a quick buck.
After googling Chris Bosh being sued, to better understand employment law, it looks his mom, the p*rn industry, and his driver have him in court, lol.
There are exempt and non-exempt salary workers. Non-exempt salary is relatively rare but is required to be paid overtime. This case pretty much will rely on how this was defined in whatever paperwork the guy signed with Bosh, in the eyes of state (and applicable federal) employment law. Sounds like all parties involved are going to have fun with this one. Personally, if I moved to TX from Cali, I'd be hiring people at TX rates and cutting ties with Cali costs. Also, Californians never met a lawsuit that they didn't like! It's pretty cheesy to have a guy to "assemble furniture" though. Haha. I can't help but think of Jeffrey from the Fresh Prince.

He's suing because he got fired after complaining to bosh about it. He didn't just went straight to suing bosh...

An employer cannot legally retaliate against a worker for complaining about not receiving overtime, and celebrities are not above the overtime law.
