Isn't the death penalty only applicable in Murder 1 or Treason cases? Technically, it was an accident, so she'll probably get charged with vehicular manslaughter or 2nd degree murder... Her boyfriend should have wondered why there were two people besides him screaming during sex...
....but once she knew the guy was slowly dieing in her garage, and Consciously decided to let him die, imo constitutes both murder and premeditation.

that chick should've drove him (in the windshield) to the hospital... you watch what comes out of this story... i read somewhere that she mentioned taking "X" (ecstacy) the media/govt is gonna run with it... you watch the stories and headlines will be something like "see what X will do to you!?" blah blah
the "x" factor was the first thing I thought of when the part about "having sex with the boyfriend" was mentioned.
