Who to blame if things get rotten.

    Let's say I get into a car wreck and I am injured. The injury isn't really that bad, but the lawyer I hired to handle the case tells me that I am hurt worse than I understand and he tells me to see this doctor who confirms his claims. Well... I know that there is a slim chance that 30 years from now I may have back problems that surface due to this very incident, but at this point I don't think it is very likely. My choices are the following:

    1) Listen to my legal AGENT and allow him to pursue a large settlement to compensate me for potential harm that I don't think is necessary.
    2) Fire my legal AGENT and tell the insurance company I want the money it costs for my totalled car and the medical bills, plus a little extra for the inconvenience and pain that I suffered for a week.

    I may be an idealist, but I would choose #2. It might be tempting to take #1, but what does that imply? It says that I don't care about what is right & wrong and I also don't care about the party that I am penalizing by doing it.

    The point I'm trying to make here is this. Moochie, Hakeem, and Shandon hired this A-hole and are allowing him to do everything that is taking place. If Moochie and Shandon want things to turn out a certain way, they instruct Fegan to act on their behalf. At any time, they can tell Fegan to shut up and get the deal done. If negotiations get rotten, it is just as much Moochie and Shandon's fault as it is Fegan's.

    Shandon and Moochie are completely responsible for whatever may happen in the near future and they have every ability to control it.

    I completely agree Doc robert. Many people feel fegan is the lord ruler in these negotiations and that his clients are being mislead and hypnotised. I feel that this is not the case and that guys like Moochie, Shandon, and Hakeem hired him for one reason: hard tactics. The harder the tactics and the less inclined their agent is to budging and blinking, the bigger the paycheck. Theres nothing wrong with that, thats just the way it is.

    Have either of you guys ever dealt with a true, devil-tongued, scum-of-the-earth lawyer before? They are basically highly trained salesmen, and rule #1 in sales is TAKE CONTROL. That includes taking control of your client. The words "if you want more (insert desired object here, usually $)" and "let me handle this" are amazingly effective when used in the same sentence.

    The first thing that an agent/lawyer does is build trust with the client. He shows them - quite eloquently, if he's worth his weight in salt - how they have been/could be ripped off, how they can take advantage of the system, who the enemy is, why they deserve more (insert here), what trying times they might have to endure to get what they rightfully deserve, and what the promised land looks like. The whole time they're making this pitch, the client is enraptured, of course, because this is the part that an agent is really good at: sounding sincere. The client is typically not a rocket scientist, so he's going to believe the agent. He's going to TRUST the agent, especially now that he knows that his fate lies in the agent's hands.

    Then the agent is going to tell him not to talk about the deal with anyone else. THAT is the point at which the serpent has taken control. I suspect that that is what happened with Hakeem.

    Logically, Mooch and Shandon can tell the Devil to agree to any deal they're satisfied with. Shandon actually did that when he signed with us the first time, so it is possible. But sales is 90% attitude/impression, and only 10% logic/brains. And that is what agents do - they're salesmen.

    That said, I expect Mooch to resign, and Shandon to either resign or accept a S/T favorable to all parties.
