I was involved in a serious car accident today, the other guy was at fault. i called the police and they made a police report and gave the other guy a ticket. I have all of his insurance info, he was driving his company's car and the car's insurance is from his company. What should I do now? contact his insurance people and file a claim? contact my insurance people first? or consult a lawyer first? My dad want me to contact a lawyer, my gf want me to contact his insurance's company first, and the witness at the scene told me I should contact my insurance people first......help me CFs

I would contact your insurance company first, if anyone was hurt or anything at that point you should get a lawyer. If your car turns out to be totalled the other guys insurance will give you a check, but you should also keep your insurance company in the loop as they will handle it all for you.

Glad you're well. And good luck.

I also like to add that I've never meet anyone as nice as the people I meet today. The guy who was involved in the accident was real nice through out the whole thing, the witness was also very nice, some guy work in an office near by came out and offer my mom and cousin water, and the police was also being very nice to every body.

If the police came, you should've gotten an police report number, you should also make sure to give that to your insurance company.

Yeah, I was involved in a similar car accident with a 18 year old kid who decided to make a u-turn where clearly prohibited and I called his insurance company and filed a claim right away and they took care of everything. Call his insurance company right away and make a claim. your insurance company does not need to be contacted neither does a Lawyer unless they are not giving you a fair deal or denying the accident, or etc. Good luck.

Thank you for the quick reply. The tow truck guy said the car is more than likely totaled as it is 8 years old and has over 100k miles.

First, you call your insurance to tell them about the accident.

Then, you call their insurance to file a claim.

You can take it to a body shop and have their adjuster go out there.

    or

Call a lawyer... tell them you got in an accident .. and your neck is hurting back .. and you might need to see a chiro .... (if you know where I'm getting at on this one)

Call your own insurance. you never know how things will turn out. it's his insurance company's job to give you the lowest amount possible, and your insurance company should be able to help/advise on this. If there are injuries, call a lawyer.

Okay, good -- someone else pictured a grim scene of the poor OP dragging himself into a nearby internet cafe to post on clutchfans...

I can't say that makes me feel better about myself, but miserable minds do like company I suppose.

police should have issued an accident report or something like that with a number, you just give that to your insurance company and let them do the rest

while we're on the topic, i do have a question, if an accident is not serious and there is no need to call the police, how do we go about handling that?

Why would you call your own insurance company unless you are having problems with the insurance of the person that is at fault. I would contact the other insurance first and if you have problems then go to your own and/or lawyer. I don't really want my insurance to know about any accidents even if I am not at fault.

if you call your own insurance they will use that against you,
contact their insurance or call a lawyer
if you call a lawyer you really wont have to worry about messing with the insurance company, insurance companies are big piles of crap who's job is to give you the least money possible, if you are aching today you might need a little bit of therapy, when i got into an accident i didnt feel the pain until a few hours after the accident, my spine got twisted in the accident (subluxation), i wish i would have contacted a lawyer cause dealing with the insurance people is no fun

Disagree, your insurance doesn't count it against you unless you or the other party is making a claim against your insurance. While you don't have to get your insurance company involved, they are useful if the other party's insurance company is being difficult and the fault is obvious (police ticketing other party, witnesses).

As for the guy being nice, it's probably because he was driving a company car and his company's insurance will cover it so it doesn't effect him.

If you need the money right away, you might consider claiming against your own insurance and have them recover the full amount against the other party. If they are successful, the accident will not count against you. If you can wait about 3-6 months, file the claim against the other party's insurance and handle it yourself.

Why would you call a lawyer? he has insurance. Don't go the scumbag route.

Contact your carrier and file a claim. They will contact his carrier and then you will go get an estimate for the damages

This. Why get a lawyer involved if it's a matter insurance companies can handle. Isn't that what insurance is for?
