Family of 5 husband, wife, and 3 children. In the state of Texas if there is no will and the husband dies does everything 100% go to the wife or does 50% go to the wife and the other 50% to the children?
http://www.legalzoom.com/wills-guide/wills-intestate.html Texas is a community property state, so this should answer all of your questions.
It is ****ing horrible. My Dad died in 2002 and his estate STILL has not been fully probated. I gave up giving a **** about 7 years ago.
I think this page explains how intestacy works in Texas: http://www.nolo.com/legal-encyclopedia/intestate-succession-texas.html That table in the middle of the page should be a pretty good guide for you.
Pretty much the same for me. My dad died indirectly due to cancer and he still didn't have a will. If he didn't care enough to ensure his estate was properly taken care of, then I certainly wasn't going to get in the crossfire. I know years later there was still issues over the estate and I still don't know what has happened with it.
My grandmother had an incurable form of breast cancer for 5 years, and never made a will over that time before she died a couple of months ago. And some of the Texas law regarding estates blows.
