Private property and private places are too very different things. You can have a public place on private property. For example, being drunk wandering around Disney World would clearly qualify at PI, although DisneyWorld is privately owned property. A bar, being open to the public, would qualify as a public place.
hell if saving lives is the issue here, let's just outlaw all modes of transportation... that would surely save tons of lives. this is utterly ridiculous.

According to the director of tabc who was just on the radio here in austin its all about public safety. Its illegal to be drunk according to him and they are experienced enough to spot drunks. They also recently got 100 more positions to help with this public safety issue. According to him if you are drunk and have your car keys in your pocket with your car in the parking lot you were going to drive drunk. Strange. I drive sober to a bar, get drunk, take a cab home all the time, unfortunately this is illegal. I will need to either change my ways or stop going out to bars...

I found this in Texas law: Texas Intoxication and Alcoholic Beverage Offenses Since there is no definition of BAC, the key word would be "MAY". I "MAY" hurt myself or someone else when I am completely sober. In fact not only "MAY" I hurt someone completely sober, I "DID" hurt someone while completely sober. I T-boned a truck doing 45 mph and broke the driver's shoulder. Does that mean I should be arrested for walking out of my apartment? I would think so.... I'm sure a sensitive enough test would detect an alcohol level in my blood from my mouthwash. How can this law possibly be enforced? I can guarantee you that I am less likely to hurt someone when I'm totally wasted than many morons I have met in my life when they are sober. I think I'll protest this weekend.

The part about people jumping from balconies into pools and missing happened two weeks ago to someone I knew in Padre. He died from the fall right in front of his friends...not that a police sting would have helped as this occured at a beach house.
