During a Thursday interview on WFAN, David Stern indicated that Tuesday's bargaining session in front of a federal mediator will be momentous. If there is no agreement by then, Stern predicted a long lockout that will wipe out games at least through Christmas.

"It’s time to make the deal. If we don’t make it Tuesday, my gut … is that we won’t be playing on Christmas Day," Stern said.

However, Stern's tone was generally positive and his outlook about reaching an ultimate resolution to end the lockout seemed optimistic.

Stern repeated his earlier assertions that the share of basketball-related income is no longer a major obstacle to completing the new CBA. The commissioner stated that deal points concerning league competitiveness, giving each team a realistic chance to win a championship, are the remaining items to be hammered out.

Stern indicated that it was the players union that invited the league to formulate a punitive luxury tax in place of a hard cap or a flexible soft cap.

The commissioner may be leaving the door open to playing a full 82-game schedule, saying that two weeks of the regular season will certainly be lost for good if a deal is not reached soon. On Monday Stern cancelled two weeks of games and was dismissive of the notion that those missed games could be made up. But Billy Hunter believes this would be possible through a compressed schedule and an extension of the regular season. Today Stern may have revealed some hope of that contingency plan should a new CBA be agreed upon quickly.

Stern was emphatic in saying that the league has no furtive wish for a long lockout or the cancellation of any games as a strategy intended to bust the players union.

This is why I have found myself siding with the players. Selig is blatantly posturing and fearmongering.

On Monday you cancel 2 weeks of the season. 1 week later you cancel the next 5.5 weeks? Then on top of if you say this before going into the meeting with the mediator just to force the NBAPA hand.

No, sir. If I were the NBAPA, I wouldn't even show up on Tuesday. Just stand the guy up. That is all he deserves.

Stern needs to shut the **** up, if he has no power to get a deal, why is anyone talking to him?

If they cancel the Christmas games they might as well cancel the whole season.

Stern has been dictating the terms all the way through. The NBAPA have no leverage whatsoever. Union De-certification becomes more and more likely with the number of games being missed increasing.

If the season gets locked out, then there is no NBA until October next year. Thats one full year from now. What are we going to do?

Why is Stern even talking right now? See how the mediating session works out and then speak to the public about where you stand then. Seemed like there's actually some hope with this mediation deal they've got going on:

...But now Stern comes in basically trying to pressure the players to take a deal now or they'll miss checks for the rest of the year. Seriously, STFU and just wait for the mediating session instead of getting the union riled up before it even starts!

Now i can understand the players trying to do whatever is best for them, but im personally all for having the league to be all around more competitive where small market teams can have a chance. And seriously how can these players be holding out these arena workers and fringe nba players just so they can keep a few million to themselves. I mean more accountability for these players to take better care of their bodies wouldnt be the worse thing because it is in fact their job. Imagine if tmac was held more accountable for taking care of his back because i know i read somewhere that he didnt put as much preparation in his body than most nba players

If players could have somehow made Stern the face of the lockout, it would have gone a lot better for them. He truly is a very unlikeable human being.

so for all you legal types, what exactly does a federal mediator do and does he have any sort of power at all? if the two sides just say "screw you, your recommendations suck" and walk out, what happens? what if one side moves and the other doesn't meet them halfway, are there any legal ramifications due to this mediator being there?

or are mediators just really persuasive and know how to make people offers they can't refuse and thus get deals done?

everybody says this, but are they really? i mean why did miami forming the superfriends make league ratings soared like 30+%? why did ratings take forever to get back to the jordan years after he retired (the 2nd time)? why was the nba largely born out of the celtics and lakers dominating the 80s? people say they want parity, but their wallets and eyeballs seem to disagree. the nfl seems to make it work but then football is just really popular. it's popular across races, in the city, in the country, young people, old people. so maybe parity has nothing to do with it. but i don't have any numbers. were ratings any different during the patriots undefeated season?

either way, until nba ratings seem to stop inversely tracking parity, i'm having trouble thinking people really want that.

or maybe the arena ticket sales in a more even league would somehow more than make up for the decreased tv money.

    A mediator gives a non-binding agreement.

Imagine the UN and DMV were joined together to solve a border dispute, but they can't say anything. That's about hoe powerful a mediator is.
