Selling a Car

    is it possible to sell a car with someone else's name on the title without them signing even if it's stipulated in, let's say a divorce, that each party is responsible for the debt of each car?

    To a dealership or privately? Personally, I wouldn't by the car without both signatures. Also, it may be hard to sell it without the title to a private party (sounds like you have no title in your post). I'd think that a dealer would require both parties to sign off on a deal, but I could be wrong.

    Sounds like someone with more legal knowledge can respond, but... are you maybe thinking that the party that can't sign has passed away...?

    Or is it that they "refuse" to sign the car over?

    Maybe one of those has merits, one doesn't. :confused:

    I think, but am not sure, that if the split of a car is stipulated in a divorce, giving one person the ownership of the car, they can have the car re-titled in their name only.

    They could then sell the car.

    I do not believe you can sign title over without all the signatures, however.

    Whoever owns the loan doesn't care what the divorce decree says. At least they don't for my friend. His ex got the Hummer that is under his name. She keeps missing payments and he has to pay extra to make sure his credit stays good. Calls to the Credit Union fall on deaf ears. They have someone who is willing to make up the payment so why would they care.

    Probably not your situation, but my father was the only name on the title to his truck. When he passed away and my mother wanted to sell it, we had to take the title to the county, show them a copy of the death certificate and then they were able to change the title to her name. We did not need to show them a will. It took a couple of weeks to get the title.

    I suspect if it is a divorce issue, since the person is still alive, they would need to sign over the title.

    That being said, I know of one couple where the woman was the sole person on the title, but her husband was able to get a loan against the vehicle without her knowledge. This was from a bank and not some shady individual (although it can be argued that banks are shady).

    I abandoned a car at a friends house when I was in hs. (his yard had old beaters in it anyway)

    He sold it a few years later without my permission.
