The actual copy of the CD is not what techniquely makes you the owner. If you have the original CD key print (often found in manuals or the cd covers), then its officially yours. I really can't think of any game off hand that does not have a CD key anymore. Becareful with ebay, sometimes you get stuck with a pirated copy.
nods, the cd key is the important thing, especially if it is a MMORPG or some other multiplayer Internet type game. If you have a pirated CD key, they will know and it will be worthless to you. However, you should stil be able to play the Single player game without a problem. If you're the lonely kind, you won't have to worry about CD keys and such

Also some people will send you the game and cd key while keeping a copy of the key for themselves so they might bump you off the online portion of the game by using your cd key.
I've sold a couple of games on ebay and I read you just have to transfer the CDs and everything it comes with. Just get everything even the box if you can.
