OK, a friend of mine just told me that he got a ticket this morning for going 68 in a 60. It was on the north Sam Houston Tollway. The thing is that the cop didn't use a radar when he pulled him over. The cop was going 60 and my friend slowly passed him. The cop was driving a suburban, not a cruiser so my friend wasn't really thinking I guess. So the cop got behind him and pulled him over. He said he was "offended and disrespected" that my friend passed him. I remember hearing that if the cop doesn't use a radar, you can get out of the ticket. All you have to do is tell them to prove how fast you were going. They have no way of proving your speed without a radar detector. Is this true?
I got pulled over last year for passing a DPS trooper who was going 55 on 290, which happened to be the speed limit. I was in a hurry so I figured he wouldn't care if I passed him doing about 57-58 (took me a couple of mins to move past). As soon as I did, he nailed me. He gave me a warning though and told me to "slow it down". ID tell your friend to consult with a traffic attorney. Most will give free consulations over the phone.
68 in a 60?? Good God, this is why I despise cops sometimes! A lot of them appear to be egomaniacs. Anyway, I don't know what to tell you ima, but I have heard the same thing. Did your friend admit to the cop that he was going 68?? He should have asked the cop if he could see his radar gun. I got pulled over about 2 and a half years ago by a cop (one of the many times that has happened to me, LOL) and he admitted to me that he didn't know "exactly" how fast I was going. However, he had "guesstimated" that it was close to 70. But when I pointed out to him that another vehicle was doing the same speed even faster than me and he acknowledged that he had seen that vehicle, he knew he had f*cked up and had to let me go. Seeing the look on that *******'s face when he realized that and had to let me go without a ticket was priceless to me!
False. Cops were writing, and proving, speeding tickets before radar was commonly used, by pacing. They have a speedometer in their car, the same as you do, except theirs is calibrated and tested on a more frequest basis for accuracy. All it really takes to convict is a cop who's positive about what speed your friend was going. If he's unsure about the exact number then yea, the citation will be much tougher to prove.
I got me a problem... i got a ticket in Bastrop County going to Austin maybe a year and half ago, never showed up to court and got a failure to appear. I need to renew my drivers liscense this January and ive got multiple letters in the mail stating that if i dont pay for this ticket i wont be able to renew. This tickets cost has gone up to like 1200 bucks because i didnt show up for court, i was speeding, and i didnt have proof of insurance on my car at the time of the incident (although i was covered just didnt have the insurance card.) Basically what im asking is if anyone knows of any attorneys out there similar to the traffic ticket attorneys in houston that could take care of this for me. Please help....
Good news: Cops are idiotic morons that can't confirm anything they do . Bad news: You need a lawyer, or the judge will believe anything the idiotic moron cop says over what you say. Learn it and live it.
If you understand that speed enforcement has nothing to do with safety (despite every bleating you hear in the media from cop spokes-morons who claim every wreck without alcohol was because of speed and therefore, the more tickets they issue, the safer everyone will be), you will realize how the system works. It's a cash cow for govt, a way to tax without representation. Buy a Valentine 1 radar detector, a Uniden BCT7 scanner with the police band alarm feature, keep your eyes open and screw the govt. before it screws you. And don't pass frickin' cop cars! Jeez, how dumb. The problem with my new state of Florida is that far too many grannies and grandpas drive the same Crown Vics that the local P.D.'s and Highway Nazi's prefer. I see a Crown Vic, I'm slowin' down!
I disagree that speed limits have nothing to do with safety, slower drivers result in fewer accidents and less damage/injury when accidents do occur. It's simple physics. I agree about keeping your eyes open. I haven't gotten a ticket in 4 or 5 years, but every one I've gotten in the past has been because I wasn't paying attention. As long as you keep a watch out for cop cars (pretty easy to spot) there's very little chance of getting caught. And yea, speeding past a cop car is basically asking for a ticket.
If people paid attention (my view is that distracted driving causes more accidents than speeding) there would be less accidents. Granted , you shouldn't be tooling around in a neighborhood at 80 mph, but an interstate? Go fast.
I agree with bama. Isn't the Autobahn one of the safest roadways in the world? I remember hearing this but not sure if it is true.
Is that really grounds for being pulled over? I say we abolish all speed limits and make more use of the reckless driving law. Pull them over and write a ticket for reckless driving if they're weaving in and out of traffic at 90 in a 55. 80 in a 70? 65 in a 55? On a (farely) empty road? Let 'em go!
