But you won't hear about it from Dan Rather or Time magazine or the Washington Post or the NAACP. That's because what happened at the University of Mississippi in the early morning hours of Nov. 6 has all the markings of a fake hate crime: An apparent racial hoax committed by black students against black students, but blamed on whites--until the suspects were nabbed last week. Three black freshmen were accused by the college of scrawling racist graffiti on the doors of two other black students in the Kincannon residence hall on the Oxford campus. Among the hateful epithets: "F-----g N----r" and "F------ Hoe N---r." Also left on walls and doors spanning three floors of the dorm: A tree with a noose and hanging stick figure and vulgar references to genitalia drawn in blue window chalk. The financial damage was estimated at roughly $600. But the cultural and psychological damage caused by such crude and twisted acts of Tawana Brawleyism is inestimable. The element of racial animus cloaks the hate crime hoax with a false sense of legitimacy. It's a manipulative attempt to exploit old tensions and deflect suspicion from the actual perpetrators. At the time the racist vandalism appeared, Ole Miss was commemorating the 40th anniversary of desegregation of its classrooms. Local and national observers immediately assumed the vandals were white. Black students organized a "Say No to Racism" march and demanded more protection against white-on-black harassment. They blasted the school's president for not apologizing quickly enough for the racial slurs. The school's "Minority Affairs" director demanded that the university establish "programs and procedures" to ensure racial sensitivity and prevent hate crimes. The "Institute for Racial Reconciliation" and the "Committee On Sensitivity and Respect" convened meetings. Activists called for criminally prosecuting the perpetrators under state felony laws or federal hate crime statutes. But now that the race of the suspects has been revealed, some are seeking to minimize the crime as a "prank." The college will not be bringing criminal charges against the trio. Instead, each suspect faces charges involving five violations of the student code of conduct--not only for the racially explosive vandalism, but also for allegedly making false and misleading statements to investigators. That's right. It wasn't enough for these accused sickos to adopt racial terror tactics, destroy property, cast false suspicion on others, and cast doubt on all bona fide victims of such perfidy. They apparently tried to lie their way out of it, too. The Daily Mississippian student newspaper noted that an "irritated Chancellor Robert Khayat said the entire situation was 'regrettable,' but it taught the university community that no members 'should engage in abusive behavior' and 'before we jump to conclusions and start condemning groups of people, we should know what happened.'" All well and good, but why allow a double standard of justice to prevail? If the attackers had been white, they faced possible federal prison time. Because the suspects are black, the most serious consequence they face is expulsion. Welcome to equal treatment under the law, 2002-style. Where is the uproar over the hoaxers' callous use of lynching imagery and flagrant exploitation of the N-word--at Ole Miss of all places? And where is the national press on this matter? Fake hate crimes are an abhorrently common phenomenon on modern college campuses, where race-consciousness reigns in such a poisonous way that it would make integrationists weep. "Students of color" are herded into separate dorms, separate departments, and separate graduation ceremonies. Segregation is back all right. But while the media elite's crack reporters are busy rummaging through the dustbins of old history in an effort to paint all conservatives as racially insensitive relics, they continue to ignore one of the outrageous race scandals of the 21st century: how the young beneficiaries of the civil rights movement are squandering and desecrating its legacy of equal respect and justice for all.
That's absurd. However, not as bad as half a century ago when it was "White man rapes a black girl, and he has a funny story for your white friends" or "Black man rapes a white girl, and he hangs from a tree". That doesn't excuse this though. I don't think they should be tried under the Hate Crimes act if it was a prank, but they should be punished more and forced to apologize to anyone who was falsely accused.
Why shouldn't they be tried under Hate Crimes Legislation? Their actions, intent, and effect on the victims was identical to that of a Klansman. Shouldn't people be held to the same legal standard despite skin color? If you think they should be judged less harshly because it was "it was a prank", why shouldn't a dumbass drunk, white frat boy get the same benefit of the doubt should he make the same error in judgement? Who are the racists and bigots in this scenario? What happened to equal protection under the law?

I would love to see you defend this statement. I assume that you think that if a white student committed this crime, then Hate Crimes law apply. Why should black students be held to a different legal standard?
I'm not even going to get into an argument with someone who can't see a difference between a prank upon blacks by blacks that used racial slurs and one done by whites. I'd agree with you if it was a prank done by blacks against whites.
I can certainly see your point, but at the same time you must admit that this "prank" caused immensurable damage on campus well beyond the destruction to property.
I gotta agree with RM95 on this one. If same race/sexual orientation/religion/ancestry/creed/color crimes are hate crimes, than are suicides as well? the victim and the one committing the crime are both of the same race/sexual orientation/etc.
LOL, you know your statement is indefensible, that is why you don't want to discuss this. You illustrate the folly of hate crimes legislation in general. In your world, a black man, full of rage and hate, can burn a cross in another black man's lawn with the intent to terrorize. If he gets caught, he can claim it was only a "prank", and get off easy. If a stupid white kid commits the same act as a "prank", you want to throw the book at him- even if the stupid kid was just exercising horrible judgement and had no hate in his heart. Hate crimes are thought crimes. Unless a judge and jury are mind readers, then a proper verdict is impossible to find.
who cares if the editorial had an opinion. all you have to do is read the facts to form your own opinion. yes this is a hate crime and it was intended to cause harm. black students did this to cause a racial backlash against whites. can you paint this any other way? i don't think you can...it is a hate crime. and my whole thoughts on the thing is that there is a significant divide between how black people view race relations and how white people do. the is A TON of racism in the black community that is allowed to go on simply because black people were wronged in the past. blacks are allowed to insult and degrade white people as if is it ok. i think it is disgusting how some black people manipulate racial issues to perpetuate being the victim and not being able to get past racism. this is one incident of that and for the nation to move on from its racist past people who are black activists and scholars need to grow out of the 1950's view of race relations and open their minds up to how things are in 2000. i'm sorry but things just aren't that bad anymore and a lot of the problems do go back to how black leaders use race for their gain and how black people force other black people to conform to the rules of acting black. flame away but its true.
C'mon RM95 how long are we supposed to be apologists? This is a simple case of a racial double standard. Were it a group of white students everyone was standing up and ready to expel them, send them to prison, heck maybe even draw and quarter them (yes that was sarcasm). However, since it's three black students it's immediately downgraded into a "prank". They're not going to face criminal charges despite acts of vandalism and obstruction of justice at least. This backtracking is rediculous and insulting to all the students who follow the school's code of conduct with the understanding that people will be prosecuted for violations. And who says that people can't be racially insensitive to their own race? If I walked up to some white guy and called him "dumb*** white trash" or worse would I be insensitive or just insulting, or both?

A racial double standard is if Blacks do that to an obvious White campus, and get treated less severely than Whites. Having said that, your sentence highlighted above shows me that you didn't read the article. The hoax was meant to be blamed on whites, thus creating a racial scandal. Therefore, it was a racial act of hate.
Racism is racism plain and simple. These kids should be facing more then just a slap on the wrist. They clearly intended the "prank" to do more then just make people laugh, they intended it to incite something. I think it is reprehensible, but not a "hate crime" by any stretch. I don't think we need "hate" crime bills anyway, just prosecute under existing laws the same for everyone regardless of skin color. DD
