I wholeheartedly agree. Optel was my cable TV company during the 2 years I lived in my apartment in West University before I bought my house. They were without a doubt one of the worst companies I have ever dealt with. Lousy customer service that included phone operators who could barely communicate & outages galore. Rocket Fan, Get the manager to tell you who his boss is, then ask him to admit to his boss, in front of you, that he will not stand behind the claims of his salesman. Make sure he says all of this in front of you. In fact, don't let him know what you are up to till you have the big boss on the phone, then hand the phone to the manager and tell him explain his position to his boss. I guarantee something will get done after that. Never let retail flunkies push you around. They all have bosses to answer to, and will move mountains to keep from being shown up in front of upper management. First off, I doubt the manager at store level is the highest ranking boss before reaching national level. Call other circuit city stores and ask about a boss over the Houston area stores. Once you get a name of someone ranking over the Houston area, go back to the store where you bought the item and ask for the manager. When he comes, say "I would like to speak to (name of Houston area boss) and explain to him how you refuse to help us in this manner." If he says that's not possible, then you say "Look, I already got his name without your help, I can get his phone number and talk to him without your help as well." If he still refuses, then do it: get his phone number and call him and tell him your situation. Rocket Fan, If you want legal help and it's worth the money and effort, I'd go that route. That's my first suggestion. Anyway, I may have missed it reading through this thread, but what exactly happened, what is the reason for you wanting a refund or get something fix (ie, what's wrong with the thing), and what is the reason they will not let you have it? Rocket River, Optel really sucks. They were my phone and cable provider two years ago at College Park. They gave my phone number to someone else- so ours was disconnected. I actualy used to do laptop repair. What's it doing? BTW Circut City employees are all on a comission. This means that they have a direct interest in selling you the most expensive item and telling you what you want to hear. Treat their statements with the same amount of credulity you would the statements of a used car salesman. ------------------
Rocket Fan, Another thing you might want to do is go to another Circuit City store and act like you are interested in buying the same product. Ask them about the extended warranty and see if the salesman says the same thing. 1. Call the Texas Secretary of State's office in Austin and take the registered agents option. Get the name of their registered agent in Texas and the agent's address. (512-463-5770) 2. Go to your nearest Justice of the Peace, pay a filing fee, sue for the purchase price, and ask for additional damages for fraud. Ask for $5000 total. The JP's staff will have forms to fill out and will assist you with filing. 3. Have the registered agent served with the lawsuit. 4. Be sure to ask for a jury trial. 5. Your total out of pocket fees will probably be under $100. 6. When they are served, they will have a couple of weeks to file an answer. They will probably contact you and attempt to resolve it then. Demand your costs be paid and get the matter resolved to your satisfaction. Because they are an opposing party, you can use all their statements against them. You can testify to the representations they told you. It is an admission by a party opponent and therefore not excluded as hearsay. By suing them, you will leap frog all the sales and managerial personnel and get to the home office legal department. They will want to resolve it because if they hire an outside lawyer to defend them, it will be costly and probably ineffective. Rocket Fan, What went wrong with the screen? Are pixels dead or did the screen completely go blank. Give specifics. The reason I'm asking is I live near a Circuit City and I'll be dropping by there pretty soon (like um, today or tomorrow). I'll present the exact same situation to the sales guy here and ask him if the extended warranty covers it. But I need to know exactly what happened to the screen. Don't just say "it's broke and they won't fix it". Tell us what's happening.
