Go Big or Go Home Donald Trump strikes again ...

New York attorney general filed a huge civil fraud lawsuit against Trump and family

New York Attorney General Letitia James has filed a massive civil fraud lawsuit against Donald Trump, Eric, Ivanka, Donald Jr., and the Trump organization. The suit follows a three-year investigation into the finances of the Trump empire. According to the legal filings, Trump and his cronies made "scores of fraudulent, false, and misleading representations" including lying at least 200 times about the value of his holdings. From CNN:

In the more than 200-page lawsuit, Attorney General Letitia James, a Democrat, alleges the fraud touched all aspects of the Trump business, including its properties and golf courses. According to the lawsuit, the Trump Organization deceived lenders, insurers and tax authorities by inflating the value of his properties using misleading appraisals[…]

James is seeking $250 million in allegedly ill-gotten funds and to permanently bar Trump and the children named in the lawsuit from serving as the director of a business registered in New York state. She is also seeking to cancel the Trump Organization's corporate certificate, which, if granted by a judge, could effectively force the company to cease operations in New York state.

The attorney general’s civil suit alleges more than a decade of deception, including billions of dollars in falsified net worth, as part of an effort to minimize his companies’ tax bills while winning favorable terms from banks and insurance companies. It seeks about $250 million in allegedly illegal profits netted from the scheme, as well as a five-year ban on the former president, Donald Trump Jr., Ivanka Trump and Eric Trump participating in any real estate transactions–a restriction that would spell the end of the Trump real estate empire. In addition, it seeks a permanent ban on the former president and his family members involved in his business enterprises from serving as directors or officers of any New York corporation or business licensed in the state.

James’s suit relies on a special statute for repeat instances of alleged violations of the law, stemming from real estate transactions. She is also filing a criminal referral to federal prosecutors in Manhattan and a separate tax fraud referral to the IRS for the same underlying allegations.

“I’m announcing that today we’re filing a lawsuit against Donald Trump for violating the law as part of his efforts to generate profits for himself, his family, his company,” James said, as she announced the action at a press conference in Manhattan Wednesday morning. “The complaint demonstrates that Donald Trump falsely inflated his net worth by billions of dollars to unjustly enrich himself and to cheat the system, thereby cheating all of us.”

“The pattern of fraud that was used by Mr. Trump and the Trump organization was astounding,” James added.

Trump’s attorneys in the probe did not immediately respond to requests for comment.

Trump has repeatedly asserted that James, a Democrat running for a second term in November, is on a political vendetta, noting that during her 2018 campaign for AG she repeatedly vowed to pursue legal action against Trump and said he should be “scared” if she was elected. During her campaign, James promised to target Trump for investigation and told voters her election would bring pressure on him similar to that posed by Special Counsel Robert Mueller.

The non-criminal enforcement action caps a three-and-a-half year investigation that state officials say began shortly after Trump’s former attorney, Michael Cohen, testified to Congress that Trump regularly inflated the value of his company’s assets in order to secure favorable tax and loan arrangements.

James is accusing Trump and his children of creating more than 200 misleading evaluations of the company’s finances and other forms of misrepresentation, including by falsely inflating the square footage of his own apartment from 11,000 to 30,000 in financial filings. As a result, Trump declared the apartment to be worth $327 million, an amount James said is significantly greater than any apartment ever sold in New York City.

James also alleged that Trump repeatedly counted cash controlled by Vornado Partnership Interests — in which Trump had a limited partnership but no access to the funds — as if it were his own. Trump also inflated the value of “anticipated income” from golf club membership fees, she alleged.

“For example, at Mr. Trump’s golf course in Westchester, the valuation for 2011 assumed new members would pay an initiation fee of nearly $200,000 for each of the 67 unsold memberships, even though many new members in that year paid no initiation fee at all,” the lawsuit alleges.

“The examples I laid out are just scratching the surface of the misconduct that we have uncovered,” James said. “The pattern of fraud and deception that was used by Mr. Trump and the Trump Organization for their own financial benefit is astounding.”

While the sweeping relief James is seeking — subject to approval by a state court judge — would cripple many of Trump’s businesses, James acknowledged at her press conference that Trump’s lawyers recently proposed a settlement, which her office rejected. But she said her team would consider future proposals to resolve the case.

“Our door is open,” the attorney general said.

James’ action is the latest in a mushrooming pileup of legal threats to Trump and may not even be the former president’s most acute legal headache as a series of other probes and trials close in on him and various figures in his orbit.

The new suit from the New York attorney general came during a week in which the former president’s attorneys were fighting in federal court to block the Justice Department’s effort to investigate the discovery of highly sensitive national security records at his Mar-a-Lago estate. Federal prosecutors are also hauling in former Trump aides and allies to a grand jury probing his efforts to subvert the 2020 election, and an Atlanta-area grand jury is reaching a critical phase in its own election-related probe.

Manhattan District Attorney Alvin Bragg is preparing to try a criminal fraud case against the Trump Organization next month and recently secured a guilty plea and agreement with the company’s former Chief Financial Officer Allen Weisselberg to testify in the trial. The former president was not charged in that case, but James said her new suit is based in part on evidence about Trump’s directives to Weisselberg to inflate various financial statements.

Trump had fought efforts to force his deposition in the NY AG’s case, but lost a series of court challenges on the issue. When he finally appeared for questioning last month, he reportedly invoked his Fifth Amendment right against self-incrimination more than 400 times.

“When your family, your company, and all the people in your orbit have become the targets of an unfounded, politically motivated Witch Hunt supported by lawyers, prosecutors, and the Fake News Media, you have no choice,” Trump said in a statement explaining why he took the Fifth despite numerous past comments he’d made about such a move signaling guilt.

I don't really understand why the media feels the need to immediately say "So let's hear what Trump world is saying...Its a witch hunt??. This is the Dems who are evil!! blah blah"...

Like why the hell do we care?? Their response to anything is as predictable as it being hot in Texas in the Summer. Turning on the news for a few minutes it seems like they've learned nothing and all they want to do is put aside the facts, and the basics of news coverage and just elevate Trump BS reality tv show that was canceled by the American people in 2018, and 2020.

There's this constant need to take every piece of bad news for Trump and reframe it as "But how is this ACTUALLY bad news for Democrats because NOW TRUMP IS READY TO FIGHT!!!".

It's ridiculous, and the media has learned nothing since 2016.

The rational behind this suit is obvious given that Alan Weisselberg has already been convicted for some of this. I personally would've liked to see her file a criminal indictment but perhaps she feels that winning the criminal case might be too dificult given how we see the DOJ acting with extreme caution and Judge Cannon contorting the law regarding Mar-A Lago.

I think it will be much less than 70 million. I know for a fact a few Republicans and Conservative leaning Independents who turned off of Trump after Jan. 6th.. If it comes ot voting for Biden versus Trump I would still give the edge to Biden. What might happen though is far less people vote for eitther. Many of those Republicans who are turned off of Trump might not vote for him but still won't vote for a Democrat.

Its quite shocking how many lawsuits this grifter has had, maybe thats why he never wants to show his tax returns, there's nothing left after paying all the lawyers and settlements...........I should say when he pays his lawyers :D

Donald Trump is involved in so many lawsuits and investigations–including allegations of election interference, business fraud, violating the Ku Klux Klan Act, mishandling presidential documents, inciting a mob, defrauding his niece and personal defamation–that it can be difficult to keep them all straight. Forbes is making that easier, with this one-of-a-kind tracker following Trump’s troubles.

In each matter, the defendants or subject of the investigation is contesting the claims made against them. Trump’s representatives did not respond to requests for comment, except for his attorney in the lawsuit against Twitter. And thanks to the Trump’s Legal Problems blog and Just Security for pointing us in the right direction for a few cases.

the sentient orange didn’t even try with these ridiculous overvaluations

If u want to buff the numbers a bit, then turning a 11k square foot apartment to 13k, or maybe stretch it to a claim of 15? Ok, maybe. But 30k square feet?!? Man, c’mon…

that’s almost 3 times the size…this man included his, and 2 of his neighbor’s apartments into 1
