From what I understand, the upgraded murder charge was necessary to charge the others as accessories. Apparently, you cannot be an accessory to third degree murder.
Optimum solution would be to get the others to plead and then have a lesser charge than second degree to ensure a conviction. Probably know more after the official announcement. The main problem is the general populace doesn't understand the difficulty in proving first degree which they keep screaming for. That being said...he is certainly working to win the current battle.
Yeah....not sure what all the timing is, but if there is not at least a conviction of Kauvin to a reasonable sentence, these protests will look like nothing.
My MN lawyer son is not too confident in the ability to prove second degree (at least not with what we have seen thus far).
All the charges we discussed in respect to the all 4 criminals end up being on point: Murder 2 for Chauvrin and accessory to murder to the other 3 defendants. It was all common sense, guys.
My son’s concern is they now have to prove he intended assault. Intent can be a tricky thing to prove.

Honestly, more than upgrading the murder charge, I would like to see some kind of abuse of power charge. If there isn't one on the books to use, we should make one. When cops murder citizens, the murder itself is only half the offense -- the other half is that he used the power of the state to commit his crime.
