I need you guys opinion. I pull into a parking lot and as I am turning into the lot I hit a huge asss rock that is sticking at least 6 inches from the curb. I hit the rock, and it not only scratches my car but dents the bottom portion of my passenger side door panel. It also scratched up my rim pretty bad. My question: Is the property management company liable to the damage to my vehicle? I think they would be, but of course im a little biased. What do you guys think?
Is there a legally defined reasonable or safe driving distance from the curb? Did you report it to the property managers on that day?
I have no idea, honestly... but did you at least take a picture of it as proof? With the rock and everything.
It happened tonight. I took pics of everything. Will be reporting it to the prop management company tomorrow morning.
Without knowing more, sounds like they could be liable. You can turn the claim into your insurance company, you're out your deductible (assuming you have collision coverage), then your insurance company could recoup the damages to your car and your deductible from the party responsible's insurance. When your insurance company gets the funds they'd send you your deductible back. Or you can call the property management company, tell them what happened, and tell them you want to file a claim on their general liability insurance to have their car repaired. They may just pay for the thing out of pocket to avoid the claim.
1.You drove into a rock!!! 2. Then want the owner of the company to be liable for your inability to avoid a stationary object thats been there for 3 billion years... Yeah sounds like a winnable lawsuit.... OJ got off, so anyhting's possible...
They have a LEGAL RESPONSIBILITY to maintain a reasonable level of safety in their parking lot. YOU sustained injury due to THEIR negligence. Make THEM pay for it. Yes, they do have legal responsibility to maintain property but they are given reasonable time to take care of the problem and warn people of the dangers. They can just say we did not know and have reasonable time to take care of the matter. IDK, its just my opinion but you got to take the hit. After all, you did run into the rock and I'm sure you seen it.
That happened to me once and the prop. mgmt didn't do crap...It doesn't hurt to build the case and ask...good luck...
