Question: I know the Air Bull song has been played at Rockets games. However, this is based off an actual song, ("Zombie" by the Cranberries, as has been stated). Would that make it more difficult for this song to be played at Rocket games? Would they have to pay royalties, or anything like that?
I've heard "Air Bull", and I think that tune is off of an actual song, too. Some western song or show... I have no idea about whether or not royalties or copyright laws came into play with that one, though.
As a certified Weird Al-oholic, I can tell you that he doesn't have to pay any royalties. In fact, Weird Al doesn't even have to get permission from an artist to do a parody, although he does get permission from every artist he spoofs, out of respect for that artist's work. As long as the lyrics are original, he can spoof any song he wants He DOES, however, have to get permission to use trademarked or copyrighted materials. He had to get permission from George Lucas to record "Yoda" (parody of "Lola" by the Kinks) and "The Saga Begins" (parody of American Pie), and he had to get permission from Michael Crighton AND Steven Spielberg to do "Jurassic Park" A-L-B-U-............QUERQUE!!!!
actually i saw a vh1 documentary or something about weird al where he paid coolio royalities for doing that spoof about his song gangster's paradise. remember, it was called amesh (sp?) paradise. anyways coolio really hated him for it because he didn't want him to make a spoof of it because of how much the song "ment" to coolio and what he "stood" for. please! some artists are so full of themselves. he really hated wierd al for that and actually threaten him with violence. the reason wierd al did it was because coolio's label gave permission to al but didn't ask coolio if it was okay. at the end of the interview al said " well, i'm sure coolio wasn't upset with the 400k check i sent him for royalities." maybe it was 500k.
SVR...Yeah, I think Al cut him that check out of guilt. He's been turned down by a lot of artists for parody ideas (he's been turned down by Prince multiple times), and hasn't written a parody without an artist's permission, except for some of his really early stuff like "My Bologna" and "Another One Rides the Bus". He learned from the Coolio incident to always go straight to the artist themselves for parody ideas
Air Bull was a parody of Jimmie Dean's "Big, Bad John" ACTUALLY, it was a parody of "Big, Bad Earl" from the Luv ya Blue Album, but who remembers that? I actually caught some grief from the company that now owns the rights to the Dean song but my attorney assured me that they have NO beef. Parodies are totally legal as long as I do not defame the original artist or use any of the same lyrics. Since my attorney talked to the aforementioned company they have not said a word about it. I hope the Rockets sign Moochie, not just to get my rocks off hearing myself at Compaq but also because I think he's a closer and brings good game to the court.
I thought that you had to pay royalties for the music as well, not just the lyrics? I remember the controversy over Vanilla Ice using what amounted to three or four bars of music from a Queen/David Bowie collaboration, and they sued and won, and got royalties. The key difference between Air Bull or this Mooch song and that is there are no profits being derived from the song, so there is no royalty issue. I thought the legality issue revolved around whether or not you could 'parody' someone or someone's work without their permission (aka The 2 Live Crew case). The Court ruled that we are free to parody public figures.
Not to be negative or anything, but let's hope that this doesn't mean Moochie is gone also. Bull got his very own special song & then he's gone the next season. hmmmmm........ Great song by the way. How about a song for Cat & Francis?
Regarding the use of music as opposed to just lyrics--Vanilla caused a storm of controversy because he compromised the original artist's integrity by claiming that his version was "the original" As long as the song is patently a parody there is no legal action that can be taken. ie-If I had released "What's on your Head" as an original performance and not as a parody my arse could be in a sling.
Cool song. I cant wait for the Hornets Pre-season game in Raleigh because I'm going to drive in to the parking lot blasting Air Bull as loud as possible. I love both of the songs and look forward to the next one...
My favorite part about Coolio being all pissed it that gangster's Paradise is actually a remake of the Stevie Wonder tune 'Pastime Paradise' off of Songs in the Key of Life! Talk about the pot calling the kettle black... In case you haven't heard it here is a link to a page in korean.. I wasn't sure about it at first - but like all of your songs so far it grows on you Great work Chance! Am now anxiously awaiting a song to inspire Cato to play hard Air Bull is still the undisputed champ tho - that was an instant classic. I'm sure many others will join me in burning CDs once we get a couple more songs.
