Facing 60 years a federal judge hands down Ed Rosenthal a 1 day sentence!!

    ----------------

'Guru of Ganja' sentenced to 1 day in jail

SAN FRANCISCO -- Ed Rosenthal, the self-proclaimed "Guru of Ganja," walked free today after a federal judge sentenced him to one day in prison for growing mar1juana Rosenthal said was for medical purposes. He could have gotten 60 years behind bars.

Rosenthal's case represented the latest clash between state and federal authorities over the medical use of mar1juana. The federal government does not recognize medical mar1juana laws in the nine states, including California, that have them.

In February, a jury concluded Rosenthal was growing more than 100 plants, conspired to cultivate mar1juana, and maintained an Oakland warehouse for a growing operation.

Rosenthal, 58, had said he was acting as an agent for Oakland's medical mar1juana program, an outgrowth of a 1996 medical mar1juana initiative approved by California's voters.

But jurors were not allowed to hear those arguments, and several of them later said they would have acquitted Rosenthal had they known.

Today, U.S. District Judge Charles Breyer sentenced Rosenthal to one day in prison on each of three counts, to run concurrently, and then set him free after declaring Rosenthal had already served that time. Rosenthal also was fined $1,000 and will be on supervised release for three years.

The ruling was met by cheering and applause in the courtroom.

"I take responsibility for my actions that bring me here today. I took these actions because my conscience led me to help people who are suffering," Rosenthal said outside the courtroom. "These laws are doomed."

Federal law does not permit legalization of mar1juana for medical use, although Alaska, Arizona, California, Colorado, Hawaii, Maine, Nevada, Oregon and Washington allow it.

Well, for starters, Griffin wasn't growing the stuff and we don't have medical mar1juana laws in Texas...

He doesn't even deserve that single day in jail or all the legal trouble he had to go through. He was helping alot of people--he deserves to be allowed to do that undisturbed.

Great outcome! There is some news right now in Oregon/Washington that Congress is reviewing a bill right now that would penalize those states that allow medical mar1juana by taking away federal money used to investigate drug traffickers; apparently so the money can be diverted to federal agencies that would try to uphold National laws against mar1juana.

I just can't believe our nation is so consumed with something so trivial. They argue that the mar1juana industry is violent but that's only because its ILLEGAL! Hello!?!?!?!

I`m sure it`s some sort of technicality but why werent the jurors allowed to hear this?

In February, a jury concluded Rosenthal was growing more than 100 plants, conspired to cultivate mar1juana, and maintained an Oakland warehouse for a growing operation.

Rosenthal, 58, had said he was acting as an agent for Oakland's medical mar1juana program, an outgrowth of a 1996 medical mar1juana initiative approved by California's voters.

Was it Judge Larry Joe of Texas justice fame? :D

Was this "bust" part of Ashcroft's operation "pipe dreams" that nailed Tommy Chong or is this something else entirely?

not part of "pipe dreams" this was something else entirely... this bust was due to California legalizing medical mar1juana and the Feds not complying and they busted him with 100+ plants... check out the full article by clicking on the link in the original post.
