    Detective recounts accuser’s testimony in preliminary hearing

    EAGLE, Colo., Oct. 9 — The woman who accused Kobe Bryant of rape told investigators he attacked her from behind, grabbing her by the neck and forcing himself on her despite repeated protests, according to testimony Thursday at his preliminary hearing.

    SHE DESCRIBED A CONSENSUAL sexual encounter that started with flirtation and spiraled out of control, Eagle County Sheriff’s Detective Doug Winters said at a preliminary hearing.

    The Los Angeles Lakers’ star was joined by the 19-year-old woman on a tour of a resort where she worked, and the two ended up in his hotel suite, Winters said. After some kissing, Bryant asked the woman to show him a tattoo on her back.

    When she turned around, Bryant grabbed her by the neck, controlling her movements and preventing her from leaving, pulled up her skirt and raped her against a chair, Winters said.


    She told investigators she told Bryant “no” at least twice,
    before bursting into tears as the five-minute attack went on.

    During and after the attack, Winters said, Bryant kept asking, “You are not going to tell anyone, right?” She said she agreed at one point.

    “She said the reason she told him ‘no’ was for fear of — she didn’t want him to commit more physical harm to her,” Winters said.

    The accuser told the detective that she tried to pry Bryant’s fingers away, and he stopped. Bryant then told her to clean up and leave, and asked her not to tell anyone, the detective said in his testimony.

    Before she left his room, Bryant told her that she needed to kneel down and kiss his penis, the accuser said, according to the detective. She did that because she was scared of Bryant, and he warned her several times not to tell anyone, the detective said, according to her.

    The accuser said she then went down and told the bellman her story.

    The hearing will determine whether Bryant stands trial on a felony charge of sexual assault. He faces up to life in prison if convicted.

    Legal experts had expected the defense to waive the hearing and head straight to trial rather than allow prosecutors to lay out their case publicly for the first time.

    “The only reason the defense would choose to go ahead with a preliminary hearing when it doesn’t have to is it believes — given the minimal amount of evidence the prosecution is going to be putting on — it may gain more by cross-examining those witnesses,” said Stan Goldman, a professor at the Loyola Law School in Los Angeles.

    He suggested the defense may call witnesses to testify, a list that could include Bryant himself.

    Judge Frederick Gannett has rejected defense requests to have the woman testify and to see her medical records. He also issued a gag order.

    The hearing began as hundreds of reporters and a handful of spectators gathered outside the courthouse to catch a glimpse of Bryant.

    He arrived with his lawyers amid tight security in a caravan of three SUVs and said nothing to the crowd. He had to take off a necklace and was checked with metal detectors before walking into the courtroom.

    The 25-year-old Bryant, charged July 18, faces a possible prison term of four years to life if convicted.

    Gannett had ordered Bryant to appear for a bond hearing even if the preliminary hearing was waived. He left the Hawaii training camp of the Los Angeles Lakers on Wednesday.

    Bryant, free on $25,000 bond, was in Colorado in June to have knee surgery.

    At his initial court appearance on Aug. 6, Bryant said just two words: “No, sir,” when Gannett asked if he objected to giving up his right to an immediate preliminary hearing. Unlike that appearance, cameras were banned from the courtroom this time.

    Two district judges were on notice they might be called to preside over an arraignment. That would spare Bryant from having to come back to Eagle again in the next 30 days to answer the charge.

    Bryant has the right to go to trial within six months, but he could agree to push that back until later, perhaps after the NBA season ends early next summer.

    Either this chick is lying or Kobe is a straight up psycho! I mean according to her, he attacked her right off the bat before she even had a chance to indicate whether or not she wanted to have sex. That type of rape is premeditated, the kind you see with serial rapists and ****. :eek:

    so they found blood on his t-shirt. I'm sure there is more. Hmmm you can't get more convincing than physical evidence. I thought Kobe would get off (no pun intended) easily, it really doesn't seem like it anymore

    What would a fine or probation do? He has more money than anyone in the court room combined (well, maybe not his lawyers).
