Judge dismisses classified documents case against Trump

    Jack Smith is saying to himself thank god because now he has something easily appealable and can get her finally removed from this case.

    The special counsel statute has been challenged in the courts many times, and has always been held up. Obviously Trump will try to push the appeal up to the Supreme Court, and of course they'll do anything for King Trump, but in the meantime I do believe the 11th circuit can rule beforehand against Cannon, and remove her from the case for the time being.

    Trump was going to win (the election) anyways, but this isn't surprising. She's been the most biased judge (worse than the NY one) since the beginning when she guided and re-wrote defense's motion years ago. I think this was for a magistrate in the prior case. It's not the worst Constitutional argument ever, but this isn't her job at this point. This is district court.

    It's going to be argued before SCOTUS. As it should be.

    As Thomas said in his opinion, the question of whether a private citizen not confirmed by Congress can prosecute a President absolutely needs to be decided by SCOTUS.

    Upon careful study of the foundational challenges raised in the Motion, the Court is convinced that Special Counsel’s Smith’s prosecution of this action breaches two structural cornerstones of our constitutional scheme—the role of Congress in the appointment of constitutional officers, and the role of Congress in authorizing expenditures by law.

    The Framers gave Congress a pivotal role in the appointment of principal and inferior officers. That role cannot be usurped by the Executive Branch or diffused elsewhere—whether in this case or in another case, whether in times of heightened national need or not.

    In the case of inferior officers, that means that Congress is empowered to decide if it wishes to vest appointment power in a Head of Department, and indeed, Congress has proven itself quite capable of doing so in many other statutory contexts. But it plainly did not do so here, despite the Special Counsel’s strained statutory readings.

    Thing is we know what both of these candidates bring. I haven’t met a single person that told me any of these events have changed the way they intend to vote.
