Judge asks DA to look into perjury charges against Smith

Harris County Probate Judge Mike Wood today said he will ask the district attorney's office to investigate whether Anna Nicole Smith committed perjury while testifying on Tuesday.

Smith on Tuesday accused her stepson, E. Pierce Marshall, of possibly trying to have her killed, possibly having his father's former mistress killed and killing his father. "I don't think there's a question she committed perjury yesterday on several elements of what she was saying," Wood said. "It's hard to imagine anything inflaming the jury beyond that performance yesterday," Wood said. "I mean accusing Pierce of murdering three people with no basis at all."

Wood told Smith on Wednesday that he will find her in contempt of court if she fails to answer lawyers' questions or insists on makes statements that have no basis in fact. Smith, in a hurt, whiny voice, said she was offended that Wood didn't believe her testimony. "I am not lying," Smith said. "Your honor, I am saying that you think I am a liar."

Smith sued Pierce Marshall, alleging he illegally blocked her from receiving part of the estate of her late husband, Houston oil billionaire J. Howard Marshall II. She dropped her suit recently after a federal bankruptcy judge in California agreed with her contention and awarded her $475 million. She is testifying in Houston because Pierce Marshall has a counterclaim against her, alleging she illegally interfered with his inheritance rights by falsely claiming she is due part of her husband's estate.

"Isn't it true that not another person's name you can give us ever heard J. Howard Marshall supposedly promise
to give you half his estate?" Hardin asked. "I don't know of anyone," Smith replied.

When she appeared tired at one point, Hardin asked, "Miss Marshall, are you under any kind of medication?" "No, I'm not, Rusty," she said.

She couldn't recall the hospitals where she said she went for breast surgery and a nervous breakdown in 1995. [Note -- In other words, she could not remember what hospital she was in when he stepson allegedly told a doctor to kill her! ]

And the best line so far:

"I have been in the hospital a million times, probably," she testified. "I'm one of the sickest people you'll ever meet."

"Well, I think once again you and I agree," Hardin replied.
