No it isn't facist. Yes it should be legal. It's called freedom of speech. Employers of course cannot force their employees to vote a certain way, but they can sure as heck tell the employees what would best benefit the company, as well as what could happen if the other guy wins. Direct retaliation for voting the "wrong" way seems unlikely (how would the boss know who you voted for anyway).

The boss simply said, if you vote Obama, I will have to lay off workers. Don't know why he would think that, but in a nut shell that's all he's saying. Perfectly legal.

I don't think it matters. The employer didn't say he'd fire any employee who voted for Obama. What he did do is try to create fear amongst employees for their jobs depending on the outcome of the election.
