One of my students just discovered that he is out of status with immigration. He has been in Texas since he was six, went through elementary, middle, high school, and 4 years of college, applied for graduate school and then his status as a foreign national without an I-20 caught up with him. They are threatening to export him to a country he hasn't been to since he was six. Referrals needed fast!
does he have a few grand? Since he is now out of status he is in big trouble and has a hard road ahread.
Dang. One of my neighbors just moved back to India because his visa was up and he couldn't get it renewed in time. He had to sell his house and everything quickly. Good Luck.
I believe UH law school has an immigration clinic that provides services for free. He may be able to seek cancellation of removal.
I am not an immigration lawyer. Maybe the time elapsed might play a big part in his case, and without knowing much about him this forum is not the best place to ask. Get an immigration attorney asap. There might be a thing or two in the past that might help me. Get a lawyer asap again!
just curious... What is the worst case scenario? He takes 2 semesters off while he reapplies for legal F1 status abroad? Does he/she have a boyfriend/girlfriend who is a US Citizen... wondering if that is an option.
Can't go wrong with Gordon Quan, the ex city councilman who has perhaps the most well known immigration practice in town. Immigration law is not a field for general lawyers.
